So what kind of a defense can be used against these Non-Crimes?? Wisconsin hands out these underage drinking tickets (125.07(4)(b) like candy at a parade, they say they are non-criminal but will jail you for not paying the monetary penalty, which would seem to beillegal(the penalty) because it is non-criminal. These tickets are given if an officer just says he smelled alcohol, and for a person underageds it is not illegal to have alcohol on your breath as parents or guardians or an of age spouse can provide alcohol to these individuals. Tha statute also says " knowingly possessing or consuming". In other words the cop would have to catch them in possession or actively drinking an alcohol beverage. We also have 51.45(1) which says that you can't be charged with a criminal offense because of being under the effects of an intoxicant. This , seemingly, is frequently ignored, even though this single statutute is about 21 pages long. All in all is law enforcement just another means of tax collection?? And how can they and do they make all of these tickets stand up in court???
