I disagree.
The constitution is still in full force and effect. There are criminal cases involving constitutional questions winning in courts around the country every day.
I'm not exactly sure where this idea that 'the constitution is dead' came from, but it is unsubstantiated.
. . .And you don't have to have a BAR card to know that.
