Traffic "violations" are not criminal. They are said to be "quasi-criminal". However, courts give them a criminal burden of proof. Depending on the forum, it is likely that a court will be required to treat the "ordinance violation" (i.e. breech of contract) or "infraction" (i.e. a higher degree breech of contract) as though it were criminal and thereby give it a criminal burden of proof.
