I have been following these antics and find them quite amusing. I will not be surprised at anything tried by Saddam as he has nothing to loose. All attempts will be made to paint the trial as a sham as it seems the court is willing to bend over backwards to avoid that appearance.
Has anyone noticed the nature of the evidence the prosecution is reported as bringing forward? Videos of a rambling deathbed statement, and most testimony appears to be made by people hiding behind curtains.
What I find most intriguing about the testimony given is that in all reports I have read, there is no claim of Saddam's involvement in the reported abuses of power, rather people in his government are doing the act.
Anyone who finds himself in a position of government over men, no matter what structure of government he advertises, by assuming the authority for himself and his agents to speak and act for as well as initiate force against his fellow man, he should suffer the the same consequence of those against whom force or fraud was initiated by his agents.
It matters not whether the principal ordered, authorized, or had any knowledge of the acts of his agents. There is no excuse for lack of knowledge in government as someone not in control of his agents is unfit for the office. Further, the the principle must stand accountable for the actions of the agent.
So yes, if there is valid evidence that shows the agents of Saddam were involved in an ongoing abuse of power and he did not act to stop them, even if such an act were political and/or literal suicide, he and his agents should be rode out at dawn and well... paint your own picture based on your beliefs regarding grace and retribution and taking out the trash.
Then lets march on DC and prove we are not a bunch of hypocrites and clean up house there for all the lies, scandals, torture, killings, and general abuse of power filtering its way through the world from the US principals.

When a statute, code, or court holding changes tomorrow, does reality change? Does truth change? Does right and wrong change?
If so, there are no absolutes, and the only logical conclusion is that reality, truth, and right and wrong are determined arbitrarily on a daily basis by those with the most power, guns, and money, and the rest of us can choose to run, fight, or be their slaves.
