I would take a copy of (off the top of my head) 26 USC 3401 with you, the part that says the employer is required to ask for the number. Tell then to send a letter to the IRS at fiing time stating they asked and it was refused. I did it (also provided the letter) and the employer never heard back from them.

The next point in that fight is that since they have nowhere to send it (as in who to record it to) don't allow them to withhold SS taxes either. After all, they are a direct tax, unapportioned.

An alternative withholding certificate should work also, but don't designate yourself as an "Employee." No title for you, just sign it.
