When you're seeking a remedy from the court, be sure to state the relevant Facts first.

State only the relevant facts, i.e., those that will determine the outcome, and leave everything else unsaid.

Anything extra only works against you.

Anything less is not enough.

Having stated the relevant facts, we need to state the Issue or Issues that have brought us to the place of asking the Court for an order or judgment.


What is it that's in dispute?

There's always a dispute.

What's the argument about?

That's what you're fighting over.

Those are the issues.


They usually begin something like this:
"Whether the plaintiff violated state law when he refused to place fire extinguishers in the halls of his hotel."

State them clearly, simply, succinctly, and then stop!

Next, state the Law that applies to the facts, the Law that should resolve the issues.

See how sensible this is?


Simply state the Law.

Don't interpret it.

Don't say what it should be.

Say what it is, and give clear citations to the Law so the judge can look it up and see what you're relying on:

A statute,

a case,

a court rule,

or some provision in your state or federal constitution.

It's the Law that controls the court.

Make certain the judge knows what the law is and where it can be found.

Finally, make your Argument.

This is where you bring the Facts + Issues + Law together with the application of down-home, simple Reason.

Be reasonable.

Don't be flowery.

Don't be verbose.

Don't make everything sound complicated.
Keep it simple!

Tell the judge to use common sense and plain reasoning ...

based on the Facts,

the Issues,

and the Law that controls the judge's decision.
