here's a question:



if the plutonium belonged to the Fed in the first place, prior to movement into/through SC, wouldn't that be considered "private property" and not a "commercial" activity?



if that's so, then the constitutional cite is definitely bona fide...



i'd actually be interested in a digest of the case before the decision to know the context/circumstances of that judgement...
