Gibson v. Weber, No. 04-3932 [8th Cir. December 15, 2005]

ADMINISTRATIVE LAW, CIVIL RIGHTS, CRIMINAL LAW & PROCEDURE, INJURY AND TORT LAW

Gibson v. Weber, No. 04-3932 (8th Cir. December 15, 2005)
Summary judgment for defendants in a suit brought by diabetic inmates against correctional officials and medical personnel under civil rights laws is affirmed where plaintiffs failed to exhaust their administrative remedies and there was no evidence the officials had thwarted or obstructed the grievance process.

Exhausting administrative remedies available under the law is a must until someone demonstrates otherwise. The appellate court certainly agrees.
