Correction on Malen & Associates....

this collection agency DID NOT serve me notice on bank levy I had no idea where they came from but my bank account was just withdrawn by them and they stated they will keep the levy on until the 9,000.00 is paid off. I know it can't be legal, however, I'm unsure how to go about addressing this. Any suggestion? direction? file to research/review? forms?
Thanks

Let's trace the steps.

Please share that which can so that give enough
for us to know what transpired?

Then, we can find the Remedy.

Quote:
1. Were you served the court's Summons?

2. Did you put an Answer?

3. Was there a Trial or Summary Judgment attended by you or defaulted?

4. Were you served the judge's decision?

5. Did you receive the extortion letters from Malen?

6. Do you, still, have them?

7. Anything else that may be useful on your part?

It all goes certified mail, to all parties, and all the certified numbers are all typed on the documents.

All of my work is done to look as professional as possible.

The envelopes have printed addresses, and the certified mail green cards are printed, not handwritten.

I think Lisa Madigan will be very interested in this one.

Her office has been very helpful.

I wish all to learn from those who have
the experience, trying to arrive to what works
better - as close to that as possible.

The member - Leatherlips found such and I,

SL: I am not endorsing anyone here.

I was asked of Cohen & Slamowitz classactioin.

That what I found out.

It appears that this lawyer is handling it.

The way it is posted, it looks like he won.

If your venue is a lawyer, then ask the one who
claims a win.

My opinion is that lawyers get almost all of the
proceeds from class action, leaving a Consumer -
the actual victim about $1,000 bucks.

Quote:
I would have done the following:

1. get all the copies of the whole, wining case;

2. study it;

3. apply that which worked to my case;

4. combine personal matrixes with the wining ones;

5. post that I search for those who like to join;

6. once have, at least, three Consumers who shared
their abuse on record or that have solid proof,
then, proceed in the Federal Court in combined action;

7. It is up to us to win, but, we would become much
stronger anyway and would help other Consumers,
in the process;

8. When other lawyers do that for you, you remain
weak, passive and, maybe with a $1,000 but don't
forget paying upfront retainer to a lawyer;

9. Sometimes, the case is taken on contingency basis
(pay when win) but how many lawyers do you
need to call and search?

10. You do 1-9 when have deep desire and ability
to stay the course, otherwise, it is simpler to involve a lawyer.

Just my opinion.

Quote:
SL: I listed him because it appears that he represents
Consumers' Rights and his mindset has to be a bit more humane than representing anyone who pays.

Specialty means a lot.

Yet, I do not know him and have not had
personal reviews shared with me.

Please post here if he agrees to take
your case on contingency basis -
that would say a lot about his
confidence to win and decency toward you.

On the other hand, let's invent or re-invent
a semi-maxim:

Testing waters is fine - tasting wine is better!
What can I do? Comes out naturally. (:

Quote:
Class Action:

Class action lawsuits are unique tools in the law that enable many people who have been injured or taken advantage of to pool their smaller claims together so that, overall, the amount lost is higher and the costs are lower because they are shared by more people and institutions that have been damaged by the fraud. Class actions can be used in many ways, such as consumer fraud, securities or stock fraud, stock price manipulation, or breaches of fiduciary duty. It sounds complicated, and in some ways it is.

Federal and state governments have enacted laws to protect consumers from improper or illegal advertising, marketing, and pricing practices. When these consumer protection laws are violated they frequently affect many consumers. If the violation results in excessive fees being charged -- or oppressive contract terms being inserted in a consumer sale or loan or mortgage contract, or false or defective claims about a product -- chances are that hundreds, if not thousands, of consumers have been taken advantage of in just the same way.

Check your, local State's court under your name.
Get the index number and court certify all
documents in the file.

Could you update if did it?

I am dealing with Malen now for someone
