My understanding is that ....

A land patent is a muniment and works in law.

A deed is a color of title and works in equity.

The land patent is absolute owernship.

The deed of trust is equitable ownership.

This all has to do with rights (property) and the subject matter of property.

Any and all rebuttals (or affirmations) are welcome to my statements above.

I just got an idea. The process and information on land patents may be contained in Am. Jur. or Corpus Juris Civilis.

Land patent info

I'm trying to find my way thru the entire process. So I apologize if, I have to keep asking questions. But, I guess my question is can I use a deed of trust in a Land Patent sandwich.

I just want your opinion

Trooper,

I have respected your posts in the past and would like to know how you got out of paying property taxes.

However, your initial post on this thread is copied directly from Brent Johnson's method. Problem is even Brent has admitted to me personally it will NOT work!!!!!! So now I am at a loss.....

A deed of trust is equity. A land or letters patent is at law.

My opinion is no, you cannot. I apologize for lack of case sites or other information to substantiate my claims. For now, feel free to presume all I have stated as unsubstantiated claims.

There was, at one time however, a common-law mortgage.

What is it you are trying to do? There is lots of material on land patents on this site. You'll have to surf around to find it. The site www.1215.org also has information on land patents as well.

Again, I welcome all rebuttals (or affirmations) of any of my statements. I am more concerned about truth, validity, facts, and precision. Any additions are welcomed as well.

Update

I have had my hearing in District Court - they ruled for the defendant that the plaintiff take nothing, that the defendants recover the cost of court.

Defendant never produced any evidence. I got all my evidence into record. Judge is sitting under "martial rule" and as I understand he could not rule on my patent.

Petitioner's request for injunctive relief is denied.

In the event of an appeal, each side may submit proposed Findings of Fact and Conclusions of Law to the Court for consideration.

I should have my court transcript soon and then I will decide what course I must take.
