Credit River Money Decision

James E. Leuenberger recently purchased certified copies of the entire Credit River case and studied it. Being an attorney he emailed me that he thinks the appeal got going by Order from a higher court and was settled before any appreciable hearings on it. However he admits the terms of the settlement are difficult to find.

My stance is that since the FRNs were determined inadaquate for payment of the appellate filing fee in the trial court, and the Bank could have paid in silver coin, the appeal never got going. Order or not. That is just a mechanical function of legal technology.

It seems of benefit to get the entire case file as Mr. Leuenberger has scanned it, archived and available for link reference in discussions on suijuris.

P.S. Yes indeedy! At a glance it looks like instead of discharging the $2 in FRNs or admitting the FRNs were funnymoney by paying the $2 in silver coin, they found a Bank employee to put his 50% holdings in Montgomery Oil on the block to pay the $2 filing fee - top of Page 2. This just gets better and better...

Dear, David!

You, always, do such, awesome research,
that the more some folks try to undermine you,
at times, the more you gain merit, in my opinion.

We, all, do make errors, but,
the overwhelming majority of your posts
are priceless, as far, as I am concerned.

I hope, those who search realize
the presence of mind
it takes to figure out:

a) where to look,

b) find the right direction,

c) a way to get there,

d) via not that easy to get hold of law-case
that proves something that the Authorities
do their best to hide from the People.

I could trace the chain of logic, events, mentally tracking your work, and
appreciate the depth of such path
you found and pursued, on top of it - SUCCESSFULLY!

A very fine compliment indeed. You and others here are very helpful in my research. It is the ideal that law is sound and remedy secure that keeps me going. I do not think that we are ruled by arbitrary and capricious judiciary - it can be understood and people can get a grasp of it.

Ever since learning of this particular case a few years ago, i have been looking for someone who either had it or had access to the archives that I could obtain a copy, thankyou for posting it, the short stories around the net are nice to read but they leave out most of the proceedings so it is hard to understand just what happened in the action..... after reading the findings of fact i can see a whoile host of things i missed in my search this past couple years against the bank...... and understand why the supreme court of idaho state refused my fathers appeal by certification where "lawful money" is an issue in a contract.... brilliant.

Thank you for posting these docs, wheter or not they actually help me in my instance or not will be determined in the future, but they already help me understand a path i might not have even traveled just barely off the main road traveled.

If you find a file with the court transcript from the trial in it please speak up which link that is in. I will ask Jim to help me with that. I was able to print that out and since then it seems to have disappeared from general internet availability. I gave my hardcopy away.

Dear, David!


As intuition and evidence of your depth have led me to
believe that you are far above and beyond "a simple
man;" therefore, your advice is of great value to me.


As I don't have any doubts that I must become
proficient in law with not excuses made, on matters of:
lack of time, full time job in unrelated field, etc,

I have to get in the mode of outperforming
corrupted attorneys.


that requires more than belief, good intentions, and
resilience, as great as they may be - they are not
adequate in Courts.

I know, already, I would be derailed on technicalities
as absurd as they may be as soon as Judges
would realize what is at stake.

I intend to take no chances.


Would you or anyone who has the suggestion be able
to recommend a particular book or on-line access to:

the core of what one needs to proceed as Sui Juris (pro
Se - prop per or even as if an attorney) in Court so that
he/she can become equipped with the technical
knowledge of the logistics of the Court process

(emphasis, for now, on - the Civil Division.)


My ultimate intentions are to go to the Court (after
learn the Civil part to the Supreme Division and engage
the list of laws, I have already chose, where the
injustice must be confronted in a solid effort
to reinstate the True Justice.

It is not wise to spread oneself too far and in vain -
I need a precise direction of where to obtain
the core of the knowledge of Procedures,
themselves, from the scratch.


I would figure out the rest by my own research
and abilities.

Procedures have nothing to do with common sense
and abilities.

That is given.

Therefore, this is something I must accept as is.

Any suggestion?

The Libel of Review is a teaching tool - it teaches a few things about running court process from that little courthouse out front - the mailbox. It teaches how to recognize contract presentments and how to Refuse them for Cause.

I imagine sometimes sitting Judge Roy Bean down and teaching him about law...

Well. That is about what I can expect of your tactical approach above; if I understand you correctly.
