Go to the county register of deeds office and get a copy of the property description. Then file a UCC 1 at county level on the real estate description. Use a UCC 1 and a UCC 1 Addendum. Read the instructions on how to fill it out. They are meant to be confusing so just do your best to figure it out.

I have the same problem. Check out the thread on the UCC forum titled SUED FOR FILING A UCC 1.

I am in the same situation now. Can you help me with what you learned? Did laying your claim by filing a UCC 1 help? Please provide more information as to what you did and if it helped you.

Can you assist me. My sisters stole all the monies / assets from a family trust and totally left me out of anything. This was NOT what our parents intended. They committed fraud and forgery. How can I recoup and still regain my portion of our inheritance as my parents intended me having?

You need to give full details about your situation, for someone to help you out. Base on what I read, you need a lawyer to represent you for recovery.

It's called "PROBATE", and IF she spent everything, your SOL. I don't understand how she went about this, as she would have no control over any of it. Who was the executor??Seems suspicouse to me.

That UCC-1 fairy tail will only make things worse. Buy a REAL book on will's and trust's, or get a shyster to straiten out the mess.

Walking into an inheritance would be nice, but making one is more satisfying ... producing a good feeling in your heart.

You can make all the monies that the sisters stole with some good diligent education and execution (aka work). The work need not be strenuous... so I point you to another thread linked here. Look for "Sample Way 1 Perhaps an additional remuneration... a way to afford ..."

Can a will be contested or is that just a TV show?

My plan is to leave my former daughter in law as the sole recepeint of all my belongings and real estate.. My son really did not do right by her and continues to misrepresent his financial status so that she receives basically a token for child support. I am glad that she has a really good professional position and is able to live with her parents who provide an excellent, clean and pro child learning home for my grandson. They are liberal with visitation for me to see him. Is there a way my son could contest to this and gain control of this property? I dont want to leave it to my grandson, because my son would finagle it from him. Thanks.

There are any number of reasons a will can be contested and overcome, and a great deal depends upon your state’s laws. This is something that professional advice is needed for. A do it yourself will is not a good idea, particularly if there is going to be contention.
