Level of effort...

Thanks for the response RushPat.

Effort is not a problem. It is the planning. I do carry some debt that I need to discharge... (Hey, I bought the stuff, I'll pay for it even thought I used bank credit. That's a battle I don't need right now. ) And we have considered selling the house and getting something smaller once the kids are out of the house.

I am looking for info on setting up the anonymous LLC right now. Any pointers in that direction would be very helpful.

Mike,
I received an intriguing flyer about setting up an LLC in New Mexico along with something I ordered from Jason(LRG) last week. From what I read, it sounded very attractive, no SS required being at the top of the list!
I'd give you more info, but this isn't the commercial or services forum. You might want to contact Jason. He, or LRG, might respond. If they do so in a timely manner, then go for it. If it is like pulling teeth with no responses or empty ones, then I suppose it is buyer beware!
And I haven't perused this site to see if there is a link to it. I was just responding to your request.

I understand what you say about choosing your battles. Even though I seriously considered the debt cancellation methods spoken of here and many other places, I found that it was a battle that wasn't worth it for me either, at least, not at this point. I find it easier to just pay for the bogus card debt and be done with it. Other battles were more important.

Your biggest problem is going to be with the tax agencies. And that is because someone is reporting your SSN to them and some amount of taxable wages on either a w-2 or 1099 or whatever. If you are truly serious about getting out of the system, I would suggest leaving any position you are in that has your SSN being reported. Perhaps you could subcontract your work through an anonymous LLC after you set one up. Any company that wants to engage your services will then 1099 your LLC's tax ID, not your SSN. Because NM, IL and some other LLCs are anonymous, there is no mention of the members. If the number of members of an LLC are under 10 (or is it 7?), then the LLC doesn't have to file business tax forms, it's considered passthrough to the members. Then again, there are no members listed, so the assumption is that somewhere, someone is claiming the income on their personal tax returns. Just a thought.

You may want to go ahead and file the return on the final year that you got a W2 or 1099 with your ID, and then evaluate whether you want to continue filing or not based on what you know of the tax agency. I'm not sure, but my guess is, that when the W2's and 1099's quit showing up with your SSN, then the tax agencies may stop looking for you, just a guess. That would be the least resistance path out, but that's just my theory right now.

Thanks for the info and the editing advice. I will be working on both and let you know what I find out.

I like the NM LLC idea. My thought was to actually have a trust or two own the LLC. Thoughts on this idea?

In New Mexico, the only information required for the Articles of Organization is:

(1) the name of the company and the address of the principal office.
(2) the name and address of the resident agent (to be explained shortly), and
(3) the duration of the LLC, which is usually 50 years.

This state does not require the names of members or managers. (Managers, in any case, are not recommended.) The mailing address of the principal office can be anywhere in the world. There are no annual reports. Thus, changes in membership take place in total darkness. Neither are there any annual fees. Compare this with California's annual $800 minimum franchise tax!

The laws in all states require that both corporations and limited liability companies have a resident agent in that state who can receive official communications and send them on promptly to the owner or manager of the company. This must be a real street address, not a mail-receiving agency. (If the resident agent resigns-such as for non-payment of his annual fee-then a new resident agent must be found within a short time. If not, the state will dissolve the company.)

On the NM LLC, how would it apply for an EIN?

As I recal (having done this already), to get an EIN, SOMEONE with a SSN or ITIN (or another business) must use their number to apply for the one for your LLC.

You can be a ghost, but someone has to step up and be identified.
