My first time ever on any forum.Love the interaction and support i've been seeing.Someone locally has helped me with some VOD letters and creditor disclosure letters on four different cards.One was a credit line for healthcare at a dental office.Got a letter from a law firm in K.C. 9-16-04 saying they had been "employed" by MONOGRAM CREDIT CARD BANK OF GEORGIA to bring about collection of $3996.37.The person helping me said I should send VOD letter. My question is: if the VOD letter contains the terminology of:this is not a refusal to pay,it is a notice that the debt is disputed, am i on quicksand? I seem to be reading posts that say don't dispute,validate.

Also, any thoughts on the letter in the forms and letters section called letter to a debt collector.Their letter tells me if I don't dispute it within 30 days they will assume it to be valid.Their letter says if the debt or any portion therof is disputed,they will obtain verification and send it to me in the mail.Also,the creditor listed is not the original.I like the letter in the forms and letter section but am not sure if it is appropriate.

reformer, you're on the right track. And you have learned, do not dispute -- request. In the event that the DC (debt collector) responds -- and that is not too likely -- just respond to the letter with a bit of rework to your original -- "thank you for your letter dated (if it is unsigned, say "your unsigned letter of (date) ). Once again I would request certified validation of the debt you claim Is owed to you -- however you worded it. Drop the word/phrase about dispute and proceed with the rest.
A mistake can be corrected!
Read and learn. and ask questions.

thanks for the response,seeker
is the reason you don't dispute it to avoid entering a controversy,legally speaking?Do they attempt to draw you into the mode of dispute to create contract or something?If I don't dispute it is it legally assumed valid?I'm sure this is all in the forum posts and i will continue to study,but I need to get a response off on this soon because of some other pressing issues.

by disputing a debt you are in essence saying "hey, i don't really owe that [i really owe this instead]." which is a far cry different from requesting verification, which basically says "i don't think i owe you anything, can you show me where i owe you something?"

I guess the entire point is -- "Hey, show me you risked someting, that you actually gave me value, and that there was no undisclosed information -- and that you have proof that you are holder in due course of a note that we both signed with full knowledge, that has not been altered in any way, and you are in possession of such an instrument." If they can do this, through certified validation, then is there a dispute? No. You would be responsible and then use your remedy to discharge the debt. But I dont think they will prove this by any stretch of the inagination! They cannot.
Yes, staying away from dispute, is to avoid recontract- by disputing you are saying there is a debt, an the dispute is to the amount owed. If they have not given you value (tender) then is there a debt? IF they used the application/agreement whatever that you supposedly signed to create 8x the face value -- who gave value to whom? And who should be owing here in this senario? IT does take some time to get your mind around the concept that they creat money out of thin air -- read Money mechanics posted her in another thread --

the BIG success story is still coming, Jerseee! But the small things with the CRAs and having some success with VoDs, and learning what NOT to do, I hope others will find that helpful.
