Stopping Phone Calls

I'm new to this website and am currently working on my credit card debt. As it is well known the calls are very annoying. Is there some form letter that can be sent to stop the calls?

zy never talk on the phone to them, i never have. the only reason they want you on the phone is so they can get you pissed off and make you say the wrong thing imop.

write them a letter stating that they are to not conduct any business with you electronically, phone, fax, etc. written communication is fine.

send it certified

don't argue

And idea?

I have a pay as you go cell phone. What I do is never charge the phone, or add minutes but the number stays the same, and it is still the number for the cell phone. I put this number on public forms. It satifies the form for a phone number. I not lying because it is a valid cell phone number where I could feasibly be reached.

At some point in time, I may actually charge that phone or I may or may not buy minutes for it, but until that time anyone is free to call the publicly-disclosed number, there is no guarantee they will ever get an answer though.

Thumbs up Thanks

After posting my message, I decided to do a little more research and wrote a basic draft for my letter... But, after reading the additional posts and suggestions, I found that my letter was missing quite a bit of information and will use information for all that have posted to finalize the letter.

Thanks Again,
zyzzx

The bottom line is this......its better to deal with CA's with written communication only. Gives you a chance to review and edit and get 2nd opinions. Second major advantage.....it creates paper trails which you can possible hang them up with later on if the matter goes to court. You are in NO WAY obligated to give them any info like phone #, bank info, etc. I would also highly suggest keeping a log of any attempts to contact you by phone after you send them notice. Set them up for a few FDCPA violations. Finally send everything certified mail returned receipt to do***ent your actions.

Way to go!!! Do your own work and research--you'll gain knowledge immensely this way. You're on the right track!

Also, the FDCPA (Fair Debt Collection Practices Act) is only enforceable by you. this means that you have to put them on notice of this Act. It is best to do it in writing and have proof that they received your correspondence.

zyzzx, you are on your way. Don't get frustrated and stop because nothign worked the first time around. Stay on them and amass your evidence. Stay in honor and you'll be fine. Good job.

extract:

3.3 Phone scripts to use with Third Party Collectors

Commentary on the morality of debt: We believe that if we owe, we should repay.

The fallacy is that we rarely owe when a collector calls. The following phone scripts are not mean spirited when we
realize that the caller is trying to get us to pay money that we don’t owe!

In spite of caller id or other screening, if a collector calls you,
Thank you for calling. May I have your full name please? Thank you. Please spell your full name for
me. Now, (their name) what is your social security number? (after listening to their protest say) I just
need to have your identity so I will be suing the correct person if you violate my rights under the fair
debt collections practices act.

- or -

Thank you for calling. Do I have a contract with your company? (They’ll tell you they’re call
regarding your xyz bill). That’s not my question. Do I have a contract with your company? Don’t ever
call me again.

- or -

Thank you for calling. I was not expecting your call and I’ll need a while to look up some helpful
information. Would you please hold? (Don’t wait for their answer. put the phone down and walk
away).
