stopping phone calls from CCC

I am going through the verification process right now... I am receiving many phone calls from CCC regarding an alleged debt that they want me to verify by making payment arrangements etc... I always tell them that I don't do business over the phone, please send it in writing!

I subscribed to caller ID so that my wife doesn't have to answer these calls during the day while I am gone. But they are always calling and it is getting quite annoying for her. Is there a way to get them to stop calling, or will it only stop once the whole process is complete? Oh yeah, one has called me at work twice. I wasn't in, so I was paged. I don't like the idea of them calling my office...



Any suggestions?

you have to write them and tell them to specifically cease any and telecommunications immediately.



that oughta do it.



if they don't, (and if you are in the US), they are subject to harassment lawsuits.

Well, if this hasn't been suggested already, simply call the CCC and all other annoying debt collectors, tell them you want to update your record and give them your new home number, and GIVE THEM THE WRONG NUMBER!!! It really works, trust me. Furthermore, it's perfectly legal! According to the The Fair Debt Collections Practices Act (FDCPA), 15 USC 1601 et seq, a debt collector may contact a debtor in person, by mail (including electronic mail), telephone or telegram (i.e. facsimile). Therefore, it is not required nor is it necessary for you to communicate by telephone to resolve this matter.



With respect to your work phone, send the annoying collector a letter citing 15 USA 1692(c), the FDCPA, stating that *A debt collector may not communicate with a consumer in connection with the collection of any debt -- (3) at the consumer's place of employment if the debt collector knows or has reason to know that the consumer's employer prohibits the consumer from receiving such communication. * (See the first link attached below).



And with repect to your pager number, just tell the annoying collectors that your employer took the pager away from you or something. That outta stop the calls. :-D

So you are suggesting to LIE in order to make them leave you alone? While you challenge them on misleading you on a claim for money due? I completely disagree. You should ONLY use the Law. And only tell the truth. Otherwise, you give away your "higher ground" should it ever been needed in a court to defend your own honor.



If you get their fax number, if they will give it to you, then just drop them a quick letter stating that under the FDCPA they have to cease communication that is not written once you have asked them to do so IN WRITING. Print out a copy of your fax transmission as "proof". Remind them in that letter that ignoring your request will at minimum cost them $1000 per the FDCPA, and that you are keeping a log of all calls. Go download all of the FDCPA cites I uploaded and find what you need. The phone will stop ringing if they are convinced you know the law and will actually defend yourself. It has for me every single time. I just don't suggest being illusive - it could come back to bite you.

Master: (Most) Debt Collectors, Lawyers, and Judges know nothing about truth, honor, and higher ground. And *the law* is whatever the most persuasive attorney deems it to be in a court of law . . . . . .

To lie about a liar is futile. To steal from a thief to prove they stole something is more dangerous than righteous. Keep "clean hands" and attack. It would be very difficult for one to attack you back if you have stayed in honor the whole time.

I agree with you Jerseee but one could easily say that they changed their number. People change their phone numbers all the time. Besides, whether or not someone lies about giving a bill collector their telephone number is a nonissue since, under the FDCPA, a collector may communicate with an alleged debtor through other means (i.e. mail, email, fax). There is no requirement stating that a collector MUST have an alleged debtor's telephone number.
