Question Question about Credit cards

Hello everyone I’m new to the group and I apologize if this has been went over before.

I am currently taking an attorney for a credit card to task over not being able to produce my original application. He sent me a copy of a telemarking sale report, trying to state this is my original application. Mother maiden name is wrong, I pointed this out and no where on it do I see my signature in my handwriting.

My claim is show me where I signed something.

Does anyone know the law or has case law on this?

Paul,

They will never produce your original application. There are many reasons for this.

You need to study a lot about the nature of credit cards, and find out how credit is really generated.

I am also new and can tell you there is a lot to find out.

Seeking the help of a lawyer is not a good idea.

Clear out your bank before the debt attorney does. And monitor the court to make sure there are no actions proceeding against you without your knowledge(even thou the plaintiff is suposed to send you a copy of everything they file with the court, often it doesn't happen which result in a default judgements for the debt attorneys, They do it on purpose. There are good consumer advocate attorneys, you just have to find one. And that takes cash.

I just received a notification letter to my card agreement.Bank Of America is raising my interest rate.Should I write" I accept it upon proof of claim" How Can I eliminate credit card by novation?Kevin

The Creeps already have your consent with the original 'agreement' they sent you that states that they may up your interest rate at any time for any reason they want. Thats why the government needs to reinstate anti-Usuary laws(but they never will). They have also gotten allot more hip to novations that include any 'discharging the debt' types of language in that they also include lingo in that 'agreement' or in statements sent to you that any extra language added to a payment stub or check will not be accepted. Altho every once and awhile someone actually gets one thru! But I believe it is much tougher to get these days? I wish you the best of luck if you choose this path. Be prepared to be chased by an endless array of creeps and debt attorneys. Since everything is on computer data bases these days the creeps can find out all sorts of info by just clicking away. Clear out your bank account and monitor your local court to see if any actions are pending against you once you embark on this journey. These clowns will chase you for just about ANY amount claimed.
As for incorrect information that may be in your account info such as wrong mothers maiden name, etc. they will skate right around this issue as well.

What Masterduke said. If you have not been to court yet, you still have remedy with refusal for cause and stating in a public court setting that you do not volunteer to contract. This is spreading like fire through my local area and a few have instituted this with good results. The farmers have given up and this is the bane of the USA. This information is symbolic of hope.
