Any Sucess stories using AFV for CC?

It my understanding that first trying to AFV the cc bill you stay in honor from the very beginning. If the cc does not except the AFV you can then discharge with a CPN or BoE which ever you prefer. I believe american express is

currently ok with AFV and the administrative process.

Interested in all thoughts on the matter.

I had a friend that did the AFV and they eventually came back. She contacted me and we put a BoE Admin. process together. On one of her accounts the paperwork was returned to her stamped "Paid". hehehe. And that was the BIG one -- I think it was over 11 grand.



There are a lot of different opinions on this. I have yet to see the AFV actually make a collector ( <u>Any</u> collector ) go away.



CC's are in the category of "loans". My opinion on this is stated elsewhere in this forum.

Cool on the 11k discharge. I am doin a little dance for that one. However u say CC's are in loaning business? I suppose you are right I mean they send monthly statements just like everyone else. I was under the impression the AFV would keep your line of credit rolling without interruption of silly pay me disputes by the CC? Your thoughts on the matter are greatly appreciated.

well, u got to look at the fact that debt collectors are trying to make money off uncollected debts, so u have to afv anything they send to u also. afv always works, its just u better not go and recontract with them again after your process by arguing with them about it. i like winston strouts methods where he using a boe as a chapter 7 liquidation instead of sending them a promissary note .

Well if they can verify the debt from the beginning--I don't think you would have to go this far.



IMHO, you must first make them verify the alleged debt, then move from that platform. Remember you are not telling them that you will not pay--all you want is certified veriifcation of the alleged debt.



Statements of account and security agreements are not verification.

I am kinda interested in how to keep the account open and useable, without interrruption. I thought AFV and a payment of good faith would be acceptable. If they accept your promissory note then the account is discharged, then you should have the ability to continue its use as long as you discharge it properly. Quid Pro Quo. Win - win for everyone.

It will prove near impossible to " keep the account open and usable without interruption" unless one uses FRN's as one's method of payment. AFV, BOE, CPN, and any other remedy will almost certainly lead to an interruption of the use of the account. They banks don't want to let the cat out of the bag more than it already is.



Perhaps in the ultra rare cases where a bank sends letter saying something like "thank you for your payment" after having received a instrument for discharge, would one have a better chance of being able to continue to use the account.

I wish there was some way to find out which companies are going with the AFV, I have heard rumors of a few but only rumors. Once I finish up with the CRA's that will be my first approach, its not like it will be a problem (wink) to get the discharge. I don't believe they can actually close the account if they did not sign the agreement saying that are on the account with you. If only your name is on the agreement then you should be the only owner of the account, I believe they need your permission to close your account. Unlimited power to credit can't be limited by the CC's

They do not need your consent to close your account. They can claim default and close it, to "protect"themselves. I think they want to keep it open to continue the money flow.



As to A4V -- the nice judge told me that I could not send something to the CCC and take their silence as acquiesence and acceptance of the statements claimed -- that they did not need to answe, that by using the CC you executed the contract (funny how they use the exact same thing to change terms on you!)

Seeker, that was one of the most important statements ive ever read on this forum "they use our silence to change the terms on us". like the guy who posted the administrative nature of the courts posted, its strictly about procedure when it comes to them contracting with u. EVERY single document u receive from a government against has a default response time, normally 10 days for the agencies and 30 days for the court and if u dont answer, u default. so why cant we do the same in the private. i had a attorney try to tell me that self executing contracts are bogus. well, i posted the link of the statute of frauds and if u look at the restatement of contracts 2d, they BOTH back up self executing contracts by silence or action of the other party.
