Question New lawsuit

Ok, there we start again and this time I definitely don't want to screw up and learn from my previous mistakes !

However, let me tell the details :

Being sued for creditcarddebt, sent out several validation request's and only got computer printouts which is not proper validation (the amount is also wrong).

Got arbitration notice and now here is my "Q" :

I always immediately respond (answer to complaint) and file my "objection to arbitration" with the court clerk. So far I have not recvd an answer but I like to do this with absolutely no mistakes this time so I don't get caught in any kind of wrongdoing.

What will be the next step and is it actually better to accept arbitration or better to answer the complaint and object to the arbitration ??

Since this is going through arbitration, filing with the court clerk will have exactly zero effect, since the court isn’t involved in the matter. Depending upon where you are and the local rules, you probably should have been filing them with whoever the arbiter is, but you need to look up the arbitration rules before they hang you with them.

Well I did file with the court where the arbitration will take place .(county court of common please).

Are you being sued in court or are you going to arbitration? There is a considerable difference between the two.

I am being sued in court and the documents I received give me a date for the arbitration sometimes this year !

You can reject their offer before the date. You have the right to reject it if you want to.

Check page 3 of the thread; Letter from Debt Collector. There is now a court decision that shoots a hole in the arbitration scam and goes into the question of just how one-sided this scam is.

Attack their fraud, and reject their offer. Tell them to shuffle it up their A$$.
