You need to file a suit in a
Court of Record, this will often be the
Court of Common Pleas. You should look at the Rule of Procedure for your jurisdiction, check your state constitution for the general makeup of your court system.
Of course you can check with your courthouse. However, if they think you don't know what you are doing, they may start with the Mantra, "we can't give legal advice", even though you are merely asking about their rules.
Of course, should the Debt Collecter (DC) sue you, you should consider doing a
Counter Claim when you respond to their Complaint.
