Rubin & Rothman, LLC

Seems Citibank gave up on their original collector and moved to these guys for alleged CC debt. Has anyone ever dealt with this group? Should I do my request for validation through a notary?

When dealing with thieves and thugs..

I would use a notary agency. Thieves and thugs are a difficult bunch who think they are above the law and don't hesitate to act in such a manner.

For instance if you send them paperwork via registered mail.. first they will deny they received it. Forcing you to go to the post office to obtain the proof and signature. Then they will claim that you just sent them a blank envelope or something to that effect. I think it is wise to set yourself up for notorial protest from the start. This way you are proving out of the gate that you know your rights and you know what you are doing.

New York law is a double edged sword. And yes I agree collection attorneys are scum. I don't know how those guys sleep at night... maybe that is why most of 'em are bald.. conscience burning off their hair at night.

Securing Assets

I read this all the time in the threads.
Do these weasel really come in suck your accounts dry?
If so, how would I go about "securing" what I have?

Blind trust

The best way to secure your assets is with a blind trust. That way you own nothing but control it. Politicians and the rich elite use this method. Additionally with a blind trust ownership of property cannot be traced back to you. This is how the British monarchs and elite bankers like the Rothchilds hide their assets. I have attached an Estate Manual that explains how trusts work in great detail.

Notary Protest

trooper, do you have or know where to get any good reading material or examples on how to start a notarial protest, do you start using a notary with the first VOD letter or only when you want to default them? Thank you.

From what Ive been reading you can only do a "notarial protest" if someone is refusing to accept a presented negotiable instrument. It is called a protest of commercial paper. How could a VOD and default letter be considered a negotiable instrument/commercial paper in order for a notary to accept to do a "protest"? Im sorry Im new at this and still learning, Im having a hard time understanding this. Please help.

Notary

A notary is your witness that you did in fact place the documents that you claim you did into the package that was sent. It doesn't matter what it is. Just because you sent a thief a registered mail and they signed for it doesn't prove the contents. This way you have a witness statement proving the contents so the thief cannot deny what they received.

PREPARE THE DOCS FOR THE NOTARY

You are to:

1. Prepare everything ahead of time:
a. Fill in all the Notary information, including first name, middle initial, last name, mailing address, city and state (and county where appropriate).
b. Fill in the month and year of all the Notices and Certificates, leaving the calendar day for the Notary to fill in.
c. Pre-address the envelopes to the “respondent”.
d. Ensure each envelope has the Notary’s return address.
e. Complete the green postcards (PS form 3811) and receipts (PS 3800)
f. Ensure each envelope has the proper amount of postage stamps affixed.
g. Ensure each envelope has a completed PS Form 3817 Certificate of Mailing for the USPS to endorse. (Some USPS will not accept these if you are using Return Receipt Postcards.)
h. Ensure each envelope contains a complete copy of the CA, attachments, and “A”.
i. Ensure each envelope has paper clipped under the flap: the Proof of Service and the three copies of appropriate Notice for the Notary to sign, stamp and seal (one for respondent, one for you and one for the notary)
j. Ensure each envelope flap has a sticky-note indicating the date you anticipate the Notary will sign and mail the documents.
k. Prepare the two original Notary Notes documents (one for you and one for the Notary) which recaps the Notary’s findings.

2 Create a “Mailing Date List” showing each mailing date with the name of each Notice and each recipient for the Notary. Keep a copy for your records.

3. Include a 9”x12” Self-Addressed Stamped Envelope (SASE) for the Notary to return to you all of your documents the Notary signed, sealed and stamped and the correlating Certificates of Mailing, green postcards, and receipts, with the notary’s notes.

If you are mailing to more than one person of the same creditor, complete a PS Form 3877. You may list multiple recipients at the same creditor company, but do not mix creditor companies on the same Form 3877. Be sure to include completed Forms 3877 for the Notary.
