Erroneous Presentmant #1

It may be questionable as to weather or not this is actually an erroneous presentment. They sent this by regular USP.
They fail to address any of the questions in the disclosure document. Note their goal is to respond a day late, LOL

They wrote:

APRIL 02, 2008

00000 000000
MY NAME
WIFE"S NAME
ADDRESS
CITY, STATE, ZIP

RE National City Mortgage Co. (NCMC) Loan Number 000XX0000XX

Dear Customer:

We have Received your letter dated March 24, 2008.

Your account is currently being reviewed. Upon completion of our research, we will notify you, in writing, of our findings.
Our goal is to respond to you by May 02, 2008

Thank you for the opportunity to be of service to you.
Sincerely,

Default Administration

DS 101 015 PQF

(end)

The third party witness received a "similar" document but that copy was signed by a human, my (close) copy was not.

Also note that My name, and my wife's name is in all caps as where the mortgage 'CO.' is spelled with upper, and lower case letters.

Erroneous Presentmant #2

There is no doubt that this is an erroneous presentment.
For 3 months prior to this alleged debt being challenged we tried to renegotiate the loan(sic) agreement, defer payments, and suggested several other options to which we received a cold shoulder. 'No can do.'
NOW they're all too happy to renegotiate

I'm not going to take the time right now to put all of the pages they sent me but the mortgage co. just sent a "LOAN MODIFICATION AGREEMENT" which would in essence rewrite the whole note(sic), defer all late payments, no further required offerings until June, and reduce the monthly offering to Moloch by $100.00.

SWEET!!!

I think it would be safe to say that I have them by a double handful of short hair.
It stands to reason to assume that IF they could have provided validation they would have been happy to produce what it was I asked for. instead, they want to play let's make a deal.
HA!
