Bad Check Restitution Program
aloha y'all,
Got a 'Notice of Failure to Comply' letter from the Prosecuting Attorney.& They want my husband to attend the Check Writer Education Class on Oahu, we live on one of the neighboring islands.
1) PC is from Honolulu City and County (on Oahu); we live in another island, a different county.
2) I received an 'official notice' of my husband being reported to this office back in January by Sears for a returned check.& The check was replaced with a money order for the amount written, plus the charge for nsf.& I sent the PC copy of money order proving payment was made.& I didn't read the 'official notice' carefully enough to understand there was not choice but to pay up and attend this class.& I just thought send copy of m.o. and that's, that.
I'm sending 'accept for value, return for closure in this matter.& If you return the voucher, if you are representing me or assume you are,you are hereby fired'.&
Can I attach a copy of my UCC-1 already filed with the state, showing I as the Secured Party for my husband?& Or not?& I did myself as Secured Party because husband is disabled and cannot deal with situations like these.
What do y'all think?
Not asking for legal advise, just welcome you to chime in on this discussion.

This is&good one, i need to think about this one.& because it does not sound like an offer but, what I am thinking is if one can make a counter offer to the notice.& Also, it is not an official notice--it is more like an order if you have no choice.& Could be duress.& i need to think on this.
do you mind posting the official notice so others may chime in and offer an opinion?

The 'paper work' is ready to send out to you, please advise how to send it.
My husband's heart condition cannot handle this particular situation, so he's going to send them the $150; getting a doctor's note to say he's disabled, unable to fly to Oahu to do this class and they will 'allow' him to do a home study'.
I still want the group to chime in on this one.
Note the last page did not come out clear so I will redo it when I get home.

First of all, no one can be "ordered" to perform without just compensation.& Unless the PC can produce a proof of authority to "order" a Sovereign to perform... well, he's up a creek without a paddle.

I was not quite confident at the time when I sent a 'counter check' from my credit union and not a BOE.
No problem with the assumption.
My confidence now is overwhelming, enjoying learning every day.& I sure would like to write to the PC and inform them that I'll be in their office to pay with FRN and that I'm sure that they are aware of the 'fraud' that carrys.& In fact, I'll be on Oahu in about 2 weeks for my husband's visit with a cardiologist so I wouldn't be telling a lie.
My husband is too nervous, afraid he'll be arrested.& The presentment has both of our names on it.& He wants to send the $$$.
I'll see what the morning brings, he may just say, mail this for me and don't forget to stop by the c. union for the counter check.& Hey, might just forget, I'm so busy during the day, wouldn't be the first.
