Who regulates who?
Ok I need some help here is trying to determine if my credit union falls under the privacy act of 1974 as an agency. It is a state chartered financial institution and is regulated by the Department of FInancial Institutions which falls under the National Credit Union Association which falls under the Comptroller of Currency. If USC Title 12 and CFR 12 are the codes which regulate banking, is it right to asume that request for information to correct records can be made to a bank or credit union which they must abide by under the above code? I am thinking that those regulating agencies fall under the Federal Gov so shouldnt because they regulate the credit union it can be an agency of which I can request records and records amended? I was thinking of using the administrative procedures Act as an avenue to sue the credit union for breach of contract/ fraud. I am sure they will remain silent which they have thus far and I can then move to judical review of the record of which I have and they dont do to their silence. ideas??
