Paying with a CPN
This is a letter I received after I sent a CPN to Discover Card.
Dear Greg Turn,
Thank you for your recent payment to Discover Bank the issuer of Discover Card, and Discover Financial Services, Inc., which services the Card (collectively “Discover”)
We identified your attempt to pay off this debt using an accord and satisfaction by restrictively marking your payment, as payment in full. After investigation the matter, Discover’s position is that your attempt to pay off this debt using an accord and satisfaction, is ineffective for several reasons. To be effective, a payment must be tendered in good faith, and the amount of the claim must be subject to a bona fide dispute. We do not believe the amount tendered to be a good faith offer of settlement, and our records do not reflect a bona fide dispute being raised with respect to the amount owing on the account. Since the Discover Cardmember Agreement provides that we may accept restrictively endorsed payments, such as the one tendered, without losing any rights under the Agreement, the payment was credited to the specified account as a partial payment.
If there are concerns regarding the remaining balance (I think the balance was $ 137.50 or so) listed on this account, please call us at 1 800- Discover. Experienced Account Managers are here to help 24 hours a day, 7 days a week. We wish to thank you again for allowing us the opportunity to assist you, and hope to continue servicing your future financial needs.

how much was your balance and how much did you make the CPN out for?
they excepted your payment, congrats. and now you have a remaining balance of 137.50?
i received that same letter after sending them a restrictive payment (check with agreement on back).

I think it was for like three grand or so...I sent them another CPN for 137.50 last week.

i have a bunch of questions for you.
did you send the CPN by itself?
was it notorized?
what did you write on it?
did you include a letter with it, what did you say?
did you send to theCPN to their payment, customer service or corporate address?
have you verified that in fact that CPN went towards the balance of that account?

did you include a letter with it, what did you say? Yes, just asking them to verify/validate.
did you send to theCPN to their payment, customer service or corporate address? I sent it to the address listed on their monthly statement.
have you verified that in fact that CPN went towards the balance of that account? Yes, if you re-read my letter you will see by their admission it was accepted and credited to the account.

i sent my 14 pr vod to the corporate address...yes i know the 14 pg vod is for third party collectors, and i realize it was wrong to send it when it was not intended for the original creditor. i got the same exact letter, where did the rest of the cpn go is my question, the cpn was made out for total amount. and yes mine was also signed by a notary.

Can you use a CPN for secured debt as well? I cannot find the CPN in the download link.

Which version of the VOD did you use? (the long one or the short one?)
Since the format in the download doesn't have a Notary section, did you just append an acknowledgement page to the document?
