Something is funny here......final dispositon of the case occurred on 1/9/2004 and the walker todd affidavit wasnt filed until 1/21/2005 and then again on 9/13/2007 !? It seems that the Daves lost their case. Why wouldnt the affidavit have been filed earlier on.....it was important to their case!?

I don' know if the Daves lost their case. The docket shows that it was settled by some sort of agreement between the parties. No clue as to which side that settlement favored. I believe the husband, H. Dave, died in March 2006.

But it also means that Todd's affidavit doesn't rise to the level of "testimony". It wouldn't even if the case had gone to trial; testimony is testimony and an affidavit doesn't allow for any questions. A mere affidavit, without a clue as to whether its assertion were or could be challenged is - especially in the case of an expression of opinion - very weak evidence.

As far as I can find, there's no mention (of any kind) of this affidavit in any other court case.

Walker Todd's affidavit is interesting reading.

I spoke with him and he stressed that the affidavit was basically stolen on the way to the courthouse. But his point aside from that is it was never intended for Internet publication is that one must understand the gold clause and its expression in a contract - express contract. He is irked that so many patriots will not comprehend the affidavit in the context of HJR-192 and its revokation in the mid-Seventies.

It disturbs Walker that so many Internet readers have taken his testimony out of context.

What I got out of the thread is tracing and ordering the original - Thank you Livefire! That is a wonderfully insightful post.
