Cool Wolpoff & Abramson arbitration

Received a letter from wolpoff and abramson last week, I asked for VOD.They called today looking for payment I refused they said would go to arbitration immediately. What should be my next move?

hmm clear violation of the FDCPA. if a verification is requested by the debtor, a debt collector CANNOT continue collection activity until verification has been sent to debtor.

sounds like they will continue violating the FDCPA, let them. this is your ammo to fight them. they will end up eating the debt if you play it right.

Yes, I mailed it certifiied and recieved my return receipt on Monday stamped by Wolpoff & Abramson.

I am sitting here laughing at Wolpoff. For about a week now I have been getting calls on my answering machine from these bozos regarding an alleged debt with MBNA. I am laughing because they cannot touch me or my wife. I have no bank account, not JOB, and we have a Homestead on our property, which in Florida prevents them from placing a lien on the property. I am having fun now and eventually I will tender a IBoE to MBNA and get the stipulation and agreement from them. These clowns are a joke.

Friends,

Does anyone know of an aribtration company that would "arbitrate" a "case" between myself and MBNA for me? I need to get mine confirmed before they get theirs confirmed. MBNA has filed a petition to confirm an award from NAF in superior court (you know the story), but I have stalled them out for the time being. The judge basically told me in court that whoever gets their unilateral arbitration award confirmed first wins! It doesn't seem right, but who am I to argue.

So if anyone could share the contact info. for a fast and consumer friendly arbitration company that could help at a reasonable price, I would sure appreciate it.

Are you sure you want to arbitrate? Or do you want to get your award confirmed? I would run like hell and try to beat them to the finish line. May I ask what state you in? You can PM me if you do not want to put that info out in the open. I am running right now with my freaking hands tied behind my back and it s*%ks. Just a word of advise should you pay someone to get your award confirmed for ya. Make damn sure that they file the motion BEFORE you give them any money.

I'm in CA, and for some background here's what has happened so far:

1. MBNA got an "arbitration award" from NAF that says yep, you owe $16K

2. A few months pass, I hear nothing (and unfortunately for me do nothing either)

3. Local attorney files a "petition to confirm arbitration award" in Superior court

4. I object and attempt to do discovery (all I'm asking is that they show me the valid, enforceable agreement); incidentially I opted out of arbitration long ago

5. Judge says I have no right to do any kind of discovery and sanctions me for trying

6. In arguing my case, I tell the judge that under his rules it's just the first person who gets their unilateral arbitration award confirmed first that wins, JUDGE AGREES with that statement.

7. Now I want to try to get my own unilateral arbitration award confirmed first before MBNA gets theirs confirmed, but I don't have an arbitration award yet.

That's where I'm at right now. I'd like a company to give me the award I need(MBNA won't respond) so I can get in there right away to confirm it fast.
