HELP!

Just tell me where to go to get the best direct information.

I just recieved a call from some collection agency about a student loan.

Here how this went down.

I attended a school in San Diego. Shortly after I completed the course someone filed a class action lawsuit against the school concerning the mis-reprensentations and claims they made about certification. I joined the class action and when it was all said and done the school lost and was ordered to pay over $100.000 Million. well the lawyers kept most of it and I recieved a check for $300.00 dollars and they are still making a claim on the debt.

Years later they took my refund from the IRS and since then I have not filed.

In the phone call the gentelman asked for my wife.

I said she is not here, what is this about?

D/C says she was referece on a student loan application and they were trying to track down me.

Stupidly I said I am he.

He proceeds to tell me I owe 6k.

I say ....send me letter with the information on it.

He says...NO

ME.... Well I can't help you then.

DC tries to trick me and says "YOU DON'T remember going to school.

I say not relevant send me the letter and we will go from there.

DC starts with threats and says all I am doing is delaying things.

(NO KIDDING I WAS THINKING)

I restate what to do.

I ask DC if he would pay an alleged debt just cause some calls and says it is so.

He skirts it and tries to trick me again with same question. I give same answer.

anyway I tell the guy send the letter and hang up. that was after he started screaming all kinds of crap.
I figure end the conversation b-4 they try to trick me again.

SO now I have this DC all over me saying he will keep calling everyday.

This is way out of control, the state of CA and the FEDS should have never given money to a school with out verifiying the course work and the supposed certifications we were supposed to get.

Bottomline it was all bunk and now i have no recourse against the school because I was part of the CLASS.


Where do I start? Is this the same as any other collector? I am not sure how to proceed being this is a government entity and they have way more wieght and the the backing of a huge legal department.

Please, all of your opinions are greatly appreiciated.

I would suggest you get an answering machine and screen all calls. If it is someone you want to speak with answer if not just let the machine take the call. This is how I handle all calls and it works very effectively. Just let all you know what you are doing and you know it is a pain, but is necessary.

Now wait for them to write to you and then answer. Never, never, answer a call without first asking, who is this calling? No matter what they say.If they do not say who they are then just say if you do not state who you are this call is over and hang up. If they state their name tell them that the call is being recorded. Then ask them for their SSN, address, etc. Never discuss anything over the phone and never answer any questions, but return the question with a question. Make them put everything in writing. That way it is not hearsay, but documented in black and white. That way you can formulate a response based on their correspondence.

STOP talking to ANYONE on the phone.

NEVER tell anyone someone isn't there -- give away -- they are sometimes
I always ask "What is this in reference to?" If they can't say, then I can't "help them". Strike one -click

As soon as he started talking about the Debt, you did the RIGHT thing -- "I don't do business over the phone. Send it to me through the mail." Click
NO you do not need to 'verify' your address -- if they got your phone number, ya think, maybe, they got your address? Duh! how dumb do they think we are ...

Get that answering machine, and USE IT. OR, next time they call, pick up the phone, say just a minute -- put the phone down and walk away. Check back later to see if they've gone! They'll get real tired of this.

They WILL mail you something, and then you do the VoD -- how do you know WHO they are? WHO they represent? If they own the alleged debt? If they have the power to negotiate? How many others also "own" it? You say it is a govenment entity -- How do you know? Most student loans are facilitated and serviced through banks -- pure and simple.

Beginning to see the BIG picture here? YOu are not, in BIG Trouble -- take a deep breath and step back --

File a Chapter 13 bankruptcy before the new law goes into effect, make what payments you can, and then get the "superdischarge".

Ignore the home-grown remedies that will be suggested to you, as they don't work in real life.
