CRA responses to verification request



I have requested certified verification&for the negative entries on my person's credit report.& Some were deleted, and some were not.&


They (Experian and Equifax) actually sent me a letter saying that they investigated the items for which the request had been made.They said they&verified some items and deleted others.& I sent another letter referencing the relevent sections 15 USC, chapter 41, section 1681, demanding the removal of all items that were not verified.


Here is the interesting part.& Equifax (after a second go around of letters) sent a letter saying that a XYZ bank, account No. 12345, had been verified.& However, on their newly supplied credit report (one weeek later), it no longer appears!!


Equally interesting, is that Experian (after the second go around of letters), sent a letter saying that XYZ bank, account No. 12345 was not found!& And sure enough, it was no where to be found on the newly supplied credit&report.& &


Although&Equifax removed XYZ bank, account No 12345, from the credit report, the letter they sent said that&it&had, in fact, been verified.& And as far as Experian is concerned, I would have preferred that they had&sent a letter saying that they deleted XYZ bank, instead of it somehow mysteriously having dissappeared&from the record...& I'm happy it is gone nonetheless.


Anyways, its time to&send out another demand to have them remove the couple of items that they supposedly verified, and&have not deleted.& I will&accept that the items are verified only when I see&the verification with my own eyes.& &

That's right.& Accepting just their word is not enough.& These people are as crooked as the tax agencies - you can't believe anything they say.


But I still don't see where in the code CRA's are <U>required</U> to&verify&credit card debts.& With&tax liens the CRA's&are required&verify the debt <U>before</U> they report it.& So, if they're doing their&job right, they should already have verification documents&in their files.&Nothing needs to be investigated.

That's the problem.& They are required to disclose all information&in your credit file, but what does "verify" mean to a credit reporting agency: Does it mean a note with&the person's name and address?


Section 1681(g)& Disclosures to consumers:


(a) Every consumer reporting agency shall, upon request, and subject to section 1681h(a)(1) of this title, clearly and accurately disclose to the consumer:


(1) All inforamtion in the consumer's file at the time of the request, except that nothing in this paragraph shall be construed to require a consumer reporting agency to disclose to a conusmer any information concerning credit scores or any other risk scores or predictors relating to the consumer.

Sec. 1681a. - Definitions; rules of construction


(l) Firm Offer of Credit or Insurance. -


The term ''firm offer of credit or insurance'' means any offer of credit or insurance to a consumer that will be honored if the consumer is determined, based on information in a consumer report on the consumer, to meet the specific criteria used to select the consumer for the offer, except that <U>the offer may be further conditioned</U> on one or more of the following:


(2) Verification -


(A) that the consumer continues to meet the specific criteria used to select the consumer for the offer, <U>by using</U> information in a consumer report on the consumer, information in the consumer's application for the credit or insurance, or other information bearing on the credit worthiness or insurability of the consumer; or


(B) of <U>the information in the consumer's application for the credit</U> or insurance, to determine that the consumer meets the specific criteria bearing on credit worthiness or insurability.


(3) The consumer furnishing any collateral that is a requirement for the extension of the credit or insurance that was -


(A) established before selection of the consumer for the offer of credit or insurance; and


(B) disclosed to the consumer in the offer of credit or insurance.


If that's the information CRAs "use," they "should" be able to verify it.

Yep. Just got the same thing from Experian. One of the others sent me the "normal" report. Still shows one wrong past address (tried to correct that, oh, about ten years ago....)


Already sent the "updated" requests to all three. Let the games begin....

It almost looks like , a lot of this verifying credit entries at the reporting bureaus comes down to how intelligent the clerk&( or their supervisor) is&who opens the mail. But if the # of incorrect entries on the average persons credit report is any indication , that does not surprise me.

ACTUALLY I DON'T KNOW IF THERE ARE ANY "INCORRECT ENTRIES" ON MY REPORT.& I HAVEN'T SEEN ONE.& IF ALL HOLDS TRUE IN OUR CREDIT SYSTE, ALL ALLEGED "DEBTS" WOULD BE INCORRECT ENTRIES WOULDN'T THEY?

All entries, unless there is judgment from a court or a bankruptcy,&will not&be verified... therefore they should not be listed.


The court judgments are another story and are dealt with in other ways.
