doesn't that consistute a novation???

It's open, it's public. They have been given notice -- seems to me that it is a valid novation!

Novation

n. A party's agreement to contract or substitute an original contract with a new one. A novation cancels the old agreement and is often issued when the parties determine that the payments or performance cannot be made under the original agreement's terms or the debtor will be forced to go into bankruptcy unless restructuring the debt. Although voluntary, novations are sometimes the only method to have funds paid.
