II'm also in the process of dealing with SALLIEMAE. SM just happens to be the entity the 'loan' was sold to.

I have some information that I am going to try. Since a promissory note is a promissory note is a promissory note...here is what I'm doing:

I'm going to go to the County Recorder and record my copy of the promissory note, as Setlor. That, theoretically, should put the prommissory note back into my possession/control.

They will not or can not provide the original for any number of reasons.
YES - this is 99.9999999999999 TRUE from my experience

In all cases, the court must have subject matter jurisdiction to proceed.
deprive the court of smj by challenging jurisidiction/plaintiff's claim of standing.
THAT WAY - if the court proceeds anyway, you will have valid grounds for appeal and action against the court.
since it is the plaintiff's responsibility to prove smj, the results of the challenge are predicated upon the plaintiff's action or inaction and not that of the court.

a little twist

Mine was a credit card case. They never served me with discovery but the court said I should have answered anyway? I guess everything in their discovery was deemed admitted, would they still have to produce the note. Thanks. C.

If they are going to enforce a copy of a note... then what stops one from discharging the copied note with coppied Federal REserve Notes's? That is what I'd be thinkin...

They can do what they want--its their system and game. But the idea is to expose them and have it on the record.

How they define $'s is not my concern. Lay the burden of proof where it belongs. taking on someone else's fight is more than a burden in itself because it resolves responsibility on the one who is truely accountable----your accusor.
