<FONT size=3>I received a response today®arding the unverified tax liens from Experian today.& Remember that I sent them&Jerseee's letter which&specifically told them that I cannot dispute an unverified debt, and that it was their job to verify it.& I did not include the code section above, and that is probably why they responded this way:&</FONT>
<FONT size=3>We are responding to your request to verify information appearing on your personal credit report. The items listed below could not be investigated because you did not tell us specifically why the information is inaccurate. Please send us more detailed explanations as to why you believe the information is inaccurate. For example "not mine", "paid in full" "never late" , etc.& If the status, dates, amounts, balances or other specific data is inaccurate, you shouldalso indicate what the correct information should be. Once we receive this information, we will begin an investigation, or you may log on to our website at ____ to expedite your request. When we complete the investigation process, which may take up to 30 days, we will send you the results. </FONT>

<FONT size=3>Can you believe these people? Do they really think I am that dumb to fall for their trick to get me to dispute the debt?</FONT>
<FONT size=3>I&did&NOT ask them to "investigate" the debt. I SPECIFICALLY asked them to VERIFY the debt. I don't know how many times that was repeated in the letter.&I did not ask them to INVESTIGATE the debt!!There is nothing in &Jerseee's letter&about &"investigating"& a debt.& Are they pretending not to know what "verify" means? </FONT>
<FONT size=3>Now I am glad I put the FCPA code section and definition of "Verify"&in my letters to TransUnion and Equifax, so that there will be no misunderstanding!</FONT>

Good critical reading!!! YOu snuffed out the trick and did not argue--congrats!
Now do you see why it is important to put them on notice of the code? they play these games but, stick to the code and never leave your remedy.
Give them 60 days--not 30. this will show that you are honorable and patient. This is expose them as inept and not in compliance.
keep on track. Oh, I forgot to tell you this....when you send them the initial verification letter, cite the code in it and also put the certified number on the header or footer of your letter. This is your contract number and it should be referenced for future correspondences. You only need to do certified once to all three. after that, you can just do a regular first class stamp. that is why I said my process is inexpensive. The total one should pay for all of this is about 15-20.00 in postage and labor (i.e. paper, printer, copies, etc...)
I could easily start this as a business since I always get positive results when I do it but, I enjoy teaching folks how to be self-sufficient and creative in their approach.
Way to go Tora!! Take no crap.

Jerseee, do you know where in the&FCRA it states they must verify the debt before&a&dispute?& I&can only find this&information for liens, judgments, etc.& &

(l) Firm Offer of Credit or Insurance. -
The term ''firm offer of credit or insurance'' means any offer of credit or insurance to a consumer that will be honored if the consumer is determined, based on information in a consumer report on the consumer, to meet the specific criteria used to select the consumer for the offer, except that the offer may be further conditioned on one or more of the following:
(2) Verification -
(A) that the consumer continues to meet the specific criteria used to select the consumer for the offer, by using information in a consumer report on the consumer, information in the consumer's application for the credit or insurance, or other information bearing on the credit worthiness or insurability of the consumer; or
(B) of the information in the consumer's application for the credit or insurance, to determine that the consumer meets the specific criteria bearing on credit worthiness or insurability.
(3) The consumer furnishing any collateral that is a requirement for the extension of the credit or insurance that was -
(A) established before selection of the consumer for the offer of credit or insurance; and
(B) disclosed to the consumer in the offer of credit or insurance.

Sec. 1681n. - Civil liability for willful noncompliance
(a) In general
Any person who willfully fails to comply with any requirement imposed under this subchapter with respect to any consumer is liable to that consumer in an amount equal to the sum of -
(1)
(A)
any actual damages sustained by the consumer as a result of the failure or damages of not less than $100 and not more than $1,000; or
(B)
in the case of liability of a natural person for obtaining a consumer report under false pretenses or knowingly without a permissible purpose, actual damages sustained by the consumer as a result of the failure or $1,000, whichever is greater;
(2)
such amount of punitive damages as the court may allow; and
(3)
in the case of any successful action to enforce any liability under this section, the costs of the action together with reasonable attorney's fees as determined by the court.
And
Sec. 1681e. - Compliance procedures
(b) Accuracy of report
Whenever a consumer reporting agency prepares a consumer report it shall follow reasonable procedures to assure maximum possible accuracy of the information concerning the individual about whom the report relates.
