When requesting Certified Verification



<FONT size=3>When requesting certified verification of your strawman's debt report (aka credit report) there are a couple of key items to remember.</FONT>


<FONT size=3>1. always reference this US Code to put them on notice that you serious about the verification: http://www4.law.cornell.edu/uscode/15/ch41schIII.html</FONT>


<FONT size=3>2. do not do a dispute form.Â* Simply put, how can you dispute a debt if it is not a verified, bonifide, truthful, legitimate debt?Â* They will send you dispute forms or recommend you dispute the debt so that they may conduct an investigation.Â* this is putting the cart before the horse.Â* </FONT>


<FONT size=3>If you dispute the debt, just by the mere fact that you are arguing about it, gives it legitimacy.Â* I had Trans Union try to get me to dispute the alleged debts that I wanted verified...I responded to them appropriately:</FONT>


<FONT size=3>How can I dispute an invalid entry when I do not know if it is valid from the beginning?Â* thus, bringing us back to the original request, according to title 15, chpt 41, blah, blah--- verify the debts.</FONT>

I understand about the verification process removing unwanted credit entries. Looks like&it works best on closed credit accounts. But do they work on open credit? I mean &30 days late sort of entries?&

I am testing that theory as i write you.& i have stop paying on a dept store credit card to see what happens.& At the same time i did a letter to all 3 CRAs and I demanded verification of the entries since i thought there may be some FRAUd underway.&


Well 2 of the 3 wrote back and said that a FRAUD alert had been put on my commercial person's report.& But thy did not specify if they deleted the entry.


So i must check my commercial person's report to see if they had been deleted since they obviously put a FRAUD alert on the account.


But either way it doesn't matter.& You have remedy to discharge the card with your exemption.

I used the cra request from the download area, but without the fdcpa-stuff. We'll see what happens. But I do think your idea of get info from them FIRST is absolutely the first step to take.


And that's what's going on around this household as well. By "luck of the draw," picked a "credit card," wrote 'em, and said, "Naw. I don't wanna pay this, etc etc."

You must cite the FDCPA stuff.& You need to put them on notice of the code.& Arm yourself.

I TOO HAVE SENT CERTIFIED REGISTERED VOD LETTERS TO THE CRA'S WITHOUT ANY REFERENCE TO THE FDCPA.& I GOT MY FIRST MAIL RECEIPT YESTERDAY FROM EXPERIAN.


IF THERE IS NO RESPONSE OR NEGATIVE RESPONSE, I PLAN TO RE-SEND THE LETTERS WITH THE APPROPRIATE& CODE REFERENCES, AT THAT TIME PUTTING THEM ON NOTICE.& I AGREE WITH YOU &amp; JERSEE, THAT IT'S BETTER TO GET THE BALL ROLLING EARLY IN THE FIGHT.


LET'S COMPARE NOTES AS WE GET "STUFF" BACK FROM THEM.&

Well, howdy, Ricky!


Yep, right here in the Roanoke Valley all of my 51 years. Only time I get out is when I'm in a big-truck. Easy driving, though, just VA, NC, and WV.&


I haven't heard anything yet, so I'm getting ready to re-send everything, this time with fair-credit stuff....


(I'm still thinking guns might be the best answer to all of this...getting ready to put a new post and I am SO mad I could spit nails!)
