eliminate student loan
Any info how to eliminate student loan. I received presentment from debt collector representing the U.S. Department of education for collecting default student loan. If I do not dispute the validity of this debt, or any portion thereof, in writing ,within 30 days after receipt of this notice, we assume it is valid.
The debt, purchase by one collector last year, and I send out vod and the collector stop to collect the debt. This year another collect send me a letter to dispute the validity of the debt again. What is my next move.
Any feedback or experience with this type of collections activities with student loan.B)

Re:eliminate student loan
First of all, ask all 3 CRAs to verify the debt as it appears on the credit report.
Next do not do a dispute letter, write the collector back and ask that they verify the debt according to USC 15, Chpt 41, subchapter V. And also tender a good faith payment for the full amount.
Not legal advice--this is just what I would do.

Re:eliminate student loan
Hi Jerseee!
Been roamin around a bit.
Sometimes, though, the more I roam about, reading, questioning, thinking, etc..., the more confused I seem to get about some things.
This is good, though, because it forces me to continue seeking the answer(s) so I might not be confused, but learned on the subject, process, etc...
There are numerous opinions espoused on the forum. Some appear to be right on the money, while others require more study, insight and maybe even trial & error.
One question that confuses me at the moment:
Does one tender an offer (CPN or otherwise) to the CC first and then go the CRA verification process, or should one go straight to the CRA first without any correspondence to the CC?
Just attempting to get it straight.

Re:eliminate student loan
Doc,
No problem. What I do is everyone at the same time gets paperwork from me. Debt collectors get noticed and CPNs and CRAs get demands for verification all in the same day or within a day of each other.

Re:eliminate student loan
Jerseee,
okay, the old trial & error thing continues.
I mistakenly thought that the CRA's, only, were asked to verify. So I didn't send any inquiries or CPN's, etc... to the CC company, only validation requests to the CRA's.
Funny thing is that today I received a letter from a CC asking me to please call them
as they had been trying to reach me by phone and by mail (which I know that they hadn't).
Seems that they want to talk to me about bringing my account current. Perhaps one or more of the CRA's has been in touch with them making inquiries?
Anyway, this letter seemed very strange, as I have not been late with a payment to them yet, although I have been carrying about a $7K balance.
My inclination is that I should not 'call' them, rather drop them a note asking them to be more specific about what they want.
Would this be a good time to ask them directly for verification?
If yes, should I also tender an offer with a CPN at this time?
Don't have CTC1-2-or 3, so where do I get a template of a CPN, anyway?
Gratitude again to you. At least a bit of the confusion regarding 'this' process is beginning to fade to clear.
