FDCPA HELP!!!!

I sent FDCPA letters to Band of Amerika telling them to stop calling me.

They received them on 4-2, but called again this morning.

I am on the phone with them now to get the documentation that I need squared away.

Let me know what you would do.

I am on the phone with them at the moment, and when you tell them that they can be held liable for $1000, they forget about asking for your SSN, DOB, or ID. They get sorried and start scrambling.

The lady I am talking to didn't even know what the FDCPA was.

This is going to be interesting.

Why do you conduct any business on the phone?& Simply tell them that you do not discuss business matters on the phone and that you prefer all communication to be in writing in order to protect your rights in these matters.


Then hang up.

I saw someone else mention on another forum about $100-1000 fines for FDCPA violations. Is this written in the law, or is it something that you put out arbitrarily?

The main reason I called them was to let them know that I would be writing them, and to get a couple more names for documentation.

I did accomplish that, so I feel it was a good move.

The lady I taked to was a flunky anyway, so she was basically just taking notes.

I am going to try to figure out a NoD for this action, then charge them (heftily) for my time, and offer to settle for $1000. If they refuse, we can go to small claims court, and address the issue.

THe FDCPA says damages PLUS up to $1000 can be awarded.

Since I work at home, they have damaged me by interrupting my time that I provide for my family.

Any ideas on how to pursue this in writing and a claim would be welcomed.

I will not take your replies as, nor am I seeking legal advice.

If this an "original creditor" or are they acting as a collector??


FDCPA does not apply to "original creditor".
