Re:Response from Trans Union

I sent my letter out 2-3 weeks ago, and Experian's letter came the same day as the second green card came. (I had received the first from Experian about 2 days before). I sent letters for both my husband and I.& The letters that i got from Experian had absolutely no inofrmation at all.& Basicly just telling me what they were required to do by the FDCPA.& I sent my letters and listed each inquiry separately with the name of alleged creditor and the numbers of those accounts.& Experian said I didn't send enough infrmation!& I stated I wanted a certified verification for each account listed as I had tried for several years to get this information from the alleged creditors, and I had never received it.& I stated I was requesting this info according to Title 15, Chapt. 41, Subch.3& Section 1681 etc.& They stated I didn't have enough info.& What else do they need but the name of the creditor and the account number?

Hi, Donna...

I'm starting to think that the first letter you get from Experian is an automated-response thing to anything they receive. I got one the first time as well. Try again. List the specific alleged creditor, request for verifiction, etc. See what happens. Make sure you include Experian's "report number" that was on the information they sent you.

Let us know what happens, okay?

Randy,

Thanks.& I will.& Should I just send the same type of& letter with the same information in response to their letter with the letter number on it?& I haven't heard anything from the other CRA's.& It's still early I know.& Experian responded so fast they couldn't have had time to certify anything.

Re:Response from Trans Union

Donna,

I am personally going through the same thing with Experian.

As I had mentioned to flecompte in one of my other posts, there are basically only 2 possible responses from the CRAs...

1. remove/delete the unverified info

2. What I call "delay tactics" and trying to get one to dispute by forcing dispute forms on someone.& Also, by asking for information all over again even though you may have sent them this information before.

My point is not to get frustrated.& Keep the docs that they send and keep your responses to each one.& After 60 days of going back and forth with the CRAs, I am going to apply for some type of credit and when I get denied--I now have a valid claim against them for "willful non-compliance" and/or "negligence" and I can prove my claim through the correspondences that I kept copies of.

Furthermore, before I even file a claim, I send courtesy copies of my correspondences to disinterested third parties and make my claim almost public.& Parties such as, ALCU, Better Business Bureau, a congressman/woman, a senator, a district attorney, NAACP, the IRS, and so forth.

Now a few of the organizations listed above may not sit well with some redemptors (such as the IRS).& But, it is necessary to get them to cannibalize themselves through public outrage.

what say you?

Mornin', Donna....

Yes. Just write Experian again--mentioning it's your second "request"--for verfication of specific debt(s). And DO reference the "report number" they used in their response.

And I think Jerseee's idea of disinterested third-parties is most excellent.&

Re:Response from Trans Union

Re:Response from Trans Union

jon,

The major purpose of notifying all these "third parties", is to make the offender of our remedy or rights be aware that this matter is not a private one and that they may have to answer questions about payment or due process from other parties that view this action as possible massive fraud.

Moreover, it could affect them as well one day.& The court of public opinion is very powerful as we know.

&Jerseee,&"who" are&going to file your "valid claim against them"& with?&Most government&agencies could&care less that&Experian won't delete your unverified entries, and unless&you&have a very&unusal complaint against them, you will&likely be ignored.

Equifax is the only&agency that was responsive to my request for validation.&Experian gave me the run around and&TransUnion&ignored me.& Their responses should all&be the same, yet they are all different.&They know what you want, yet they continue to give you a hard time as if they don't want you to have what you want right away on purpose,&because if they gave it to you right away, nobody would have bad credit.

So, Jerseee, are you saying that eventually Experian will give in to your requests?

Re:Response from Trans Union

jerseee, that wasn't what i meant.& the IRS is part & parcel to the Federal Reserve System, though not directly.& so i am not really certain they could be deemed a disinterested third party in any case.&

in response to tora, you'd file a complaint in federal court (united states court) for violations of the FDCPA, etc.

Tora,

What jon said.

Jon,

It really doesn't matter as long as it is a well known or semi-well known organization.& i only care about making it public.
