I requested verification of the entries on my report and also stated in the initial contact letter that I was not disputing any alledged debt, nor was I unwilling to pay them, but that I was only trying to verify them. Anybody else receive such a response? Any thoughts or opinions? I am going to draft a second letter tomTransUnion, I would just like a little input if anyone cares to opine.</FONT>

You are not disputing any "alleged" debt, but you admitted&that you have debts by saying, "nor was I unwilling to pay them".& In other words, you said that you owe them money,&but you just want them to verify them. ???



They gave you what you wanted. The names and addresses where you can verify them yourself since you admitted you owe them money.


I maybe a little presumptous that you admitted to owing money, but that's how I would interpret what you said.


No public record information means that you have no tax liens, court judgments, convictions, etc.. things that the&county recorder has&recorded.&

Thanks for the reply. I was kinda paraphrasing in my first post as to the content of my initial letter to the CRA's. My apologies. The actual wording of my contact letter is as follows:


to whom it may concern,


I am writing to make a request for "certified verification" for all items currently on my credit report. I am informing you in advance that I am not disputing any items currently on my credit report, I am asking for "certified verification" of these items as per US Title 15 Chapter 41 Subchapter III.


I appreciate your prompt attention to this matter. Please note the details below that you will need to retreive information about this account.

I then listed my name, address, DOB,& and SSN.

&


It just seems funny that they didn't include a credit report at all. Just the names of my creditors.

one mistake in your initial request was a failure to state the specific items needing verification.& you must do this.


it is like the 5th amendment - you can take the 5th amendment to each question asked, but not blanket:


"i take the 5th amendment to all questions"& WRONG - jail &amp; begin again with ALL questions REQUIRING answers - no 5th anymore!


"i take the 5th amendment to that question"& CORRECT.& go past GO!& collect $200...


proof of the latter comes from a personal acquaintance of mine whose case was before the IRS as a WITNESS - not actually on trial!& he was told, by an attorney, to "plead guilty to his name &amp; address [i.e., admit to his identity]" but answer with the 5th to each and every question - NOT BLANKET as that would lead to a re-asking of the questions with no immunity.& after some questions, the examiner asked my friend if he was going to plead the 5th to each question.& his response "depends upon the question" let him go.& if he had answered "Yes", that would be the same as a blanket 5th.


you must state which items you need verified.& this is also per the FDCPA code if i'm not mistaken.


what you'll have to do now is contact your creditors (see jerseee's method) and then re-approach the CRAs with your results and have the information re-investigated and removed.& i think that's the route i'd go.

The very first step is acquiring a copy of the actual report... then you can request they verify specific items listed.

HELLO ALL,


ICE IS DEFINITELY RIGHT.& I SENT OUT LETTERS TO THE 3 CRA'S ASKING FOR VERIFICATION OF ALL MY REPORTED ACCOUNTS.&


ALL 3 CRA'S SENT BACK LETTERS SAYING THEY DIDN'T HAVE ENOUGH INFORMATION &amp; WERE TRYING TO GET ME TO FILE A DISPUTE FORM...WHICH I HAVEN'T.& I FIND IT INTERESTING THAT THE OTHER 2 EACH SENT ME A FREE COPY OF MY REPORT WHILE EXPERIAN DIDN'T.


THEN I SENT SECOND LETTERS OUT.& ON TRANS AND EQUI I LISTED THE REPORTED ACCOUNTS, AND JUST ASKED FOR ALL CURRENTLY REPORTED ACCOUNTS AGAIN FROM EXPERIAN.& I HAVEN'T HEARD FROM THETHE FIRST 2&YET. BUT I JUST RECEIVED THE SECOND RESPONSE FROM EXPERIAN. THEIR RESPONSE WAS A DUPLICATE OF THE FIRST, STATING THEY WERE NOT ABLE TO PROCESS MY REQUEST.& SO I HAVE PULLED MY REPORT FROM THEIR ON-LINE SYSTEM AND THE THIRD LETTER GOING OUT LATER TODAY WILL HAVE THE ACCOUNTS LISTED FOR THEM TO VERIFY.

Well, I received a full credit report from TransUnion today. Don't know why they sent me the first letter with all my creditors listed and nothing else. Today's letter contained my whole report along with a letter about my rights under the fair credit reporting act and also a form in case I want to investigate any of the accounts. I can hear Jerseee now, "Never Dispute"! Instead I will write back to them and ask for certified verification of the specific accounts I am working on. Thanks everyone for your input.

All,

Some of you have got it and some are still arguing. Though the actual term "argue" is not being used...long and drawn out letters are exposing your position. Tora's post reply on page one is an example of how Tora read someone's letter and saw the argument. Good job Tora.

Ice's recommendation of obtaining a report first is first and foremost. You have to know what you are demanding verification of. even if you list everything on the report item by item in your letter to the CRAs--you are being specific.
Good 5th amendment anology Jmunson.

Your letters for certified verification must be brief, concise, precise, non-argumentative and instructional. Do not request that they do their job according to the code. Instruct them on what you want without sounding pushy.

For example, "I need certified verification of the following accounts so that I may satisfy the alleged debts or address the potential fraud. This is in accordance with USC 15, Chp 41, subchp III."

Do you see how that read? It was instructional, brief, concise, precise, and non-argumentative.

reading that which I just wrote, where can one argue with that?

Do you see where I mentioned "fraud" in the letter?

This gives them the hint that you know what is up. You may know that the entry is fraudulent and by them verifying it--makes them an accessory. If you prove later that it was fraud and they verified that it wasn't....you got them.

Another thing that my method is accomplishing is a paper trail. You have a paper trail of evidence if you are ever damaged because of the "willful non-compliance" or "negligent" actions of the CRAs. You have proof that you put them on notice of the code and made an attempt to resolve your situation using the code and exhausting your means of remedy through non-judicial avenues.

This method puts you in honor, gives you standing and you can prove your claim. Now you may or may not get the answer you desire because they are not going to just roll over because you figured out the fraud. You must stay the course and gather your evidence.

I know you just want the items removed and go about your life but, they do not want that. So keep your enemies close. this is why I say they are our friends because I keep them closer than my enemies.

Y'all will like this. From Experian regarding request from me to verify specific items. Still a few things to "clean up," but all in all, not too bad. Still "investigating" the one credit card I'm "terminating."


Anyway, here's the quote I think you'll enjoy:
