Overcoming the FCBA argument

Unsecured business credit card dispute, creditor argues I do not have consumer protection under the FCBA:

How does one overcome the argument made by the creditor that I, as a business account, I have no protections under the FCBA, when:

1)there is no existence and/or proof of a personal guarantee
2)they are coming after me in my personal name
3)they claim my billing error notice not valid under 1666 or parallel CFR 226.13
