I'm not sure of the specific code but if you go to the us codes and search those areas I am sure you will find it.
Go to the site and look around, you'll be amazed at what you will find.

Okay. You have "proof" that you closed the account on whatever date, right?
I wouldn't do another bloody thing except, one time, and one time only, I would "Francis" them. ("Francis" was my mom's name. Little woman would take a red-ink pen and write her angry responses on the original info and send it back.) I.E., I would return a copy of their "original" demand/bill and tell them it was closed. Sorry for any inconvenience.
Then if THEY want to&pursue, let 'em.
How damned embarrassed are they gonna be, in court, in front of a judge, while attempting to insist that YOU "honor" a payment THEY made AFTER the account was closed?
Screw 'em.

An update for you .. the Bank appointed an ivestigator to investigate the "claim of Fraud" done to your account.& Now, where exactly is the fraud?& (Internally), why exactly should we return a signed notarize affidavit of fraud?& If I do, can I use it against them and the employee responsible for disbursement?
Have responded with a letter directing them to orginal correspondence.
Well see what's next and if they delete the charges they have levied since the account was closed.
The funny thing is, how quick does a check bounce if it is even ten cents short, on an OPEN account?&

Think about it before you do something like that.
I will pose just one question to you and then you will see the bull that they are about to pull....
Why on earth would they hire an investigator to investigate themselves? Do you really think that the investigator is going to find evidence against them?
Did you request an investigator? Did you even retain one? Do they represent you or themselves? If you sign that affidavit--you will find out. DON'T SIGN THAT THING UNLESS YOU WANT THEM TO REPRESENT YOU IN THIS MATTER.

No way would we sign and return an affidavit!& I sent a letter that in effect said --"Did you read the letter I sent you?& Do it now."& That's it.& Nothing more.& Nothing less.& Well, actually much less -- "see original letter" was about all it said.

Mostly the bank will not report the matter to CRA instead they will report to chexsystem if you refused to pay the overdraft after your account is closed.
The chexsystem is like CRA but only dealing with checking account open and closed with bank. If the bank report your closing account with overdraft on it.It will stay in chexsystem data base for 5yrs. To open a new account with another bank in any state will be very difficult except some bank that do not use chexsystem to open account. Try clear this up as soon as possible. You might try find out if they already report it to chexsystem.

Charles,
glad you brought up chexsystem. I have given my parents knowledge through advice about this young upstart "illegal" system.
You can easily get those guys, since they violate the privacy act and receive compensation for doing so. NOt to mention libel lawsuits against them especially since you have no contract agreement with them. this is why when you open a bank account you should sign the signature card with UCC 1-207 or 1-308 (whichever applies to your state).
Furthermore, you should put chexsystem on notice of your CN (TN).
Folks, do not let chexsystem get a full head of steam!!! protect yourself now from this illegal menace.

Jerseee is right on the money -- the Bank and Chexsystem would both be liable for reporting damaging information in this instance.
