I haven't filed my motion to vacate the summary judgment yet. I decided to FOIA the EDD for documents relating to summary judgment form they filed with the court. I don't expect they will answer the FOIA.



I also discovered yesterday (thanks to the curiosity of paralegal I work with) that the EDD filed an Abstract of Support Judgment with the County Recorder. The paralegal did not know what that form was so she found it online and saw that it is lien judgment for child support! I have no children. You can view this form here:

This form must also be filed endorsed by the court, but I doubt that the form is filed endorsed because I have no children! I ordered a certified copy of the form from the County Recorder so we'll see if it is in fact a Abstract for Support Judgment. A mistake might have been made by the clerk at the recorder's office-- doubtful though.



The paralegal told me that recording that form without an endorsement by the court is a total and complete destruction of my due process rights!

Another update on my battle with the EDD...



They replied to my Public Record Act request and I objected to ALL of the documents they delivered claiming not one document could be positively identified as a document responsive to my request. I gave them 10 days to cough up the right documents or I will sue them. Today I received a response to that and their answer to ALL of my requests was this:



Your objection to the department's initial reply is without apparent legal significance. Your assertion that you can "positively identify on its face'" certain documents is beyond the scope of the IPA. The remainder of your request is nonsensical and overly vague. Beyond the documents provided to you already, as referenced above, no such specific documents are known to exist.

None of the documents they delivered to me were adequate to prove anything. For example, the first request was for documents which the EDD relies on to prove that "S. Allen" (the signature on the summary judgment was, in fact, an employee of the EDD. They delivered a facsimile signature of "S.Allen" which said that this person was Tax ?? Supervisor of the CA EDD. It was dated 2001. That is the only document they delivered to me. Now tell me... how does that document prove that "S.Allen" is, in fact, an employee of the EDD?



I'm tellin ya... the corruption in this farking world is DEEP and pervasive.... I don't know what my next move is going to be. Argh...

p.s. i don't really know if that is right or allowable, but the gist is to "produce the body."
