You can't paint broad stokes when&the brush is very narrow.In other words, don't assume all financial institutions are alike.&You entrust funds to a credit <U>union</U> b/c it is a co-op and its customers have an interest in the union itself, so there is a fiduciary relationship here.& However, this is not the case when you&contract with banks and credit card companies - there is no trust relationship here. Therefore, it is not a fiduciary relationship with banks and credit card companies, but a creditor/debtor relationship.

So if I'm hearing all correctly, all I need do is ask the CC to verify the debt and enclose a CPN, leaving out all the UCC and SA stuff.

If I entrust funds to a bank, there is a fiduciary relationship.& If my boss pays me 2 weeks later for work I do today, there is a fiduciary relationship.& If I entrust a CCC with my "credit" (and the possible mishandling of my credit) there is a "fidcuiary relationship".& Remember, each of those entities hold something "in trust".& I trust the CCC's won't screw up my credit, I trust the bank or my employer will not release MY PROPERTY to anyone else or cause it to be lost or stolen.


Yes, I can paint broadly because in this instance the brush is very wide indeed.

My bad.& I tried to correct you and look what happened -I created an argument!& I hope you forgive me b/c you know my environment&is surrounded with arguments!& It is so hard sometimes to act in one capacity in one environment and then switch gears when interacting in the other.&

I see&the perspective now - I was not 'through the looking glass' and thinking in terms of the bankruptcy of the US, which does create&the proper&perspective of entrusting&our credit&to banks&by way of&the Fed. and then flowing outward from there; and&as such, the ccc's hold our remedy in that respect.& I really should have known better here!& My mind was stuck in the conventional legal framework (which I practically live in) where the court decisions&overwhemlingly support the creditor/debtor relationship and expressly&hold that a fiduciary relationship does not exist (Boulder Dam&is different as per my earlier post), when the truth is that funds are ultimately entrusted to the banks/ccc's b/c of the Bankruptcy.& So Ice, whip out that fat paint brush and create whatever painting you desire!

Your statements re&changing from one environ to another kinda resemble my own situation... but I deal a lot more with CRS than anything else.& (Ever KNOW that you have a certain document and search and search for it but CAN'T locate the damn thing?)& Sometimes I think how much easier this all would be if I had a personal secretary... and then I remember that they are just as&prone to error as I am... and it's back to square one.& I think I'd give just about anything if I could just be a bit more organized!


But the benefit of a forum such as this one... it keeps us all on our toes and with assistance from knowledgeable members such as yourself we reach new heights everyday.


I gotta tell ya'll just how proud I am to know each and every one of you.
