I have a question.

Where in the law do we get the statute that says it is illegal to purchase evidence of debt and attempt to collect on it?

Is this federal or state law?

I have seen that law quoted, but it is a Oklahoma state law. You may try to find a similar law in your state.

Squirrels, I understand fully what you are saying. The way I see it is I closed the contract, any further contact on my part would re-open it and I will be back to square one again. I originally AVF all of my cc debt, registered it. I never had a problem until I did the BOE thing, plus the default package. I Sent this lawyer collector a letter plus copies of my BOE and Default notice. I informed him it was discharged per HJR-192. So then I receive another letter with copies of unpaid cc bill statements. I will not acknowledge or re-ply I have to keep contract closed.

I know it will work out, just have to wait it out. But I did get American Express $11,865.79 cents deleted from one of my cc reports, from experian and a Providian cc also deleted off, Iam still working on others.

Another update ... regarding the D_A trying to force Arbitration through NAF --

Received a cc from the D_A that he has requested the NAF for an indefinite stay.& Reason given -- to obtain documentation to resolve the issue.& I have doubts as to if the original "Claim form" was even sent to NAF, and am tempted to pokethis guy with a bill for susequent contact and nuisance.

I am still looking for cites regarding witholding of Income tax for child support -- an validated, erroneous amount.& Have found a bit in <PRE>31 CFR Part 5 -Treasury Debt Collection; Final and Proposed Rules.</PRE><PRE>Needs closer reading, </PRE><PRE>but it sounds like the Offset act is being used for "employees" -- that opens a whole new thought process too!</PRE>

can someone who hasn't gone through the full redemption process yet be able to ask for verification of the debt on the CRA or is it only able to be verfied and discharged after the redemption process?

Please see my post under successes titled "27 deletions on CRA" I have not yet completed the redemption process. The Verifcation process is your right to Privacy and to protection under the FDCPA, among other things. If a debt cannot be verified, it must be removed. DO NOT let the CRA get away with sending you a letter saying "We have verified these accounts" ASK them HOW? What is the process they used to obtain this verification? WHO provided the information -- name, address, title, contact number they can be reached at AND A CERTIFIED COPY OF THE VERIFIED INFORMATION they received! I received reports for the other two CRAs who did nothing. Just sent the report stating, "yep, this is it." My letters to them will go out in the mail tomorrow. If one CRA cannot verify, then none can. (I learned that here!) Don't let the CRA off that easily. Make them do their work.

And let us know if you get CERTIFIED COPIES OF THE VERIFIED INFORMATION. I don't believe they are REQUIRED to give you CERTIFIED COPIES of their verification.

Two CR's have put in writing to me that they have already VERIFIED four tax liens with the county recorder - The County Recorder will not VERIFY any tax lien so either they are LYING or they are not required to prove they verified anything. I recieved a letter from Equifax the other day and they said they are investigating my request. All I ask for was the business name address, and telephone number of where they verified the liens, so I don't know what they are investigating. They are the only CR that deleted three out of the four tax liens. They said the fourth tax lien was verified as belonging to me??

So I'd really like to know if CRs are required to send you CERTIFIED COPIES of their Verification.

Seeker has a point. Look to his successes. Redemption is not just about documents--you have to believe in what you are doing and what is being taught to you. If you have no faith in your documents--then they are worthless.

Do a UCC-11 to see if there is anything filed against your commercial person (most likely not). Once you get the UCC 11 back from the state--that is your evidence that the debt is ficitious. Get 5 - 10 certified copies of that completed UCC 11 and send that to the CRAs. Let them argue with the state. If the government can't verify the liens--how can they?

You can also make the UCC 11 a matter of record in court. I'm not sure if you have done this already---I'm just responding to your post.

You don't need to follow any "redemption" path to hold someone accountable under the LAW. Use the LAW to your advantage. In the long run you will have more success.
