CC VOD

While constructing my CC VOD w/CPN, I am using the download as a template. I notice in section 6 of the 'Offer of Performance' the mention of California Civil Code and Code of Civil Procedure.

Since my domain is not California, my question is where one might find the comparable code(s) for one's own state?

Thanks for the input. I'm ready to hit 'em with the VOD's and CPN's, but don't know what I should do about this section.

Has anyone else used the VOD on this forum that does not domain in California?

If so, what have you done about section 6 in the Offer of Performance for your state domicile?

I don't believe that I should use the California code for a state other than California.

What thinks thee?

The term is "imparia materia" -- check it out.& If you are outside of California you can still site it as a point of reference for the states are to be in harmony with each other.&


It is best if you look up the code, statues, or law from your state although you may make references to other states codes again, as a point of reference

I'VE LOOKED UP "IMPARIA MATERIA" IN MY BLACK'S 7TH AND IT'S NOT LISTED THERE.& BUT FROM MY OLD HIGH SCHOOL DAYS IN LATIN CLASS I WOULD INTERPRET IT TO MEAN "UNEQUAL MATERIAL".


WOULD YOU ELABORATE ON THE DEFINITION OF THE TERM AS YOU USE IT?&

The states do not have to be in harmony with each other... each state makes its own laws.& But, the 14th Amendment provides for "equal protection under the law".& And that should sum it all up... if it is good for the citizens of one state... then it is good enough for you.
