Help needed for forclosure!!!!

Hi, I have not made a mortgage payment in 13 months and have held them off for this long with legal paper work and chapter 13. My question is so far the judge in this has answered all of my arguements as FRIVILOUS which seems to be there most famous word. The court has ignored all of my case files I presented and evidence and will not make anyone prove the debt. I am being sued by MERS my mortgage is supposed to with CountryWide but it was sold to them from GreenPoint which once CountryWide had it they sold it to an investor?? Now it took a lot of time for me to find out who the investor is but in the meantime MERS is winning in court and CountryWide and Fannie Mae(the investors) all say they own the note to my home. I cannot get the courts here in PA in my county to do anything to help me with my rights so I sent a letter to HUD they said they cannot help me. I also sent letters to Federal Trade commission, Fannie Mae, Mers, the attorney for Mers and,Government and industries and also to RESPA asking the them who owns my mortgage. No one has to date answered my letters not the mortgage companies or any federal agency. My chapter 13 is up any day now dismissed and I know from the courts still going thru the process I am going to lose my home. I am still up to the fight but need to know if anyone knows the next step to take. (my letter I sent was asking for all finacial records from day one of my mortgage and whom ever owned it or said they owned it was also sent a letter. I would appreciate any feedback. Faithchris, don't you have a Griswold UCC-1/Security Agreement/Indemnity bond? If I remember correctly, I think it was flecompet that said you had it.



If you do have it, then it is YOU that has TITLE to your home, and I would TAKE A STAND on that TO THE BITTER END.

First do a land patent. Get this done ASAP. Go to the down loads section and get that info on land patents. Learn what they are and move from there.



Second, stop arguing and pay what you allegedly owe. You have unlimited credit and you have a remedy under public policy. Furthermore, you can demand verification using (USC 15, chpt 41).



Third, stop asking the same organizations that are trying to take your home for help. HUD, Fannie Mae, etc....

If they truly wanted to help you they would give you information on land patents and how to file them.



Finally, use the codes and the law. You can do it, if you stop arguing and demand certified verification.

MERS is trying to foreclose on me, too. Have you sent the D.C./attorney a demand for verification (VOD package)?

I do have Howards Griswolds Security Agreement and I have droit Droit's also. I am in contact with Howard and need to get ahold of him this week again it is hard as many of you know to reach him. But it is not working for me. I also am NOT trying to NOT pay I don't have the funds anymore due to work related injury and workers compensation not paying properly (still in litagation). There game is to freeze you out and force you back to work which I cannot do at this time. I finally had to get myself the medical help I need to maybe able to do more than I can at this time so there is no money of mine to pay. Now I haven't done the land patent yet I will do that today. I also was not not asking HUD for help I was sending a letter that I sent the mortgage companies to fill out to the agencies letting them know what I was requesting.and they were not providing. I have properly asked for verification of several occasions and all they have sent me are copies which are not certified. Jerseee I have tried to get verification and I just will not accept the attorney's signature telling me it is true they are suing me for Gosh sakes you know what they try to pull. They have signed it to be a true copy and that doesn't work for me and should not be allowed or accepted, but it does for the courts. I have sent them verification letters written by the best and with no avail. I have had all of my legal docments written up by legal professionals (such as people in my area studing this also and spen there days and nights doing this). So I am following the laws and doing the objections and pilimary objections and answers correctly and I have a paralegal check them out before I send them for proofreading. Also while in Chapter 13 I used the Rule 2004 to demand records and the court allowed them to strick it due to it being a nuisunace and a burden to there client. The courts are really getting to be a worse nightmare then the debt collectors they are avading the law and need a good civil suit against them but I just don't want to get into that at them moment but will certainly entertain the idea at a later date when the pressure is not so bad. Flecompt also does not know me only about me from what I have written and he has never talked to me and did not return my call when I asked for his help. I also believe I need to take this to federal court but I am not good in a court room and hope I will not have to go again I shook so bad last time a friend asked me if I felt the earthquake caused by my shaking. I have no experience with mortgage elimination, but you should welcome any opportunity to go to court. Howard should be able to tell you how to put into court a Request for Judicial Notice of your UCC-1/Security Agreement. IMO, you are nervous because you don't fully understand what you have (the UCC-1).



Anyway, I am trying to get a Motion To Strike out of Howard, and don't understand why it takes so long (6+ weeks) to get back to me. It's a simple request. If he doesn't have one, just send me a note... how long does that take. Geez... and I refuse to buy the excuse that he is too busy. Howard has not been much help to me, that's for sure.

Maybe someone familiar with Griswold should ask him to join suijuris. It would enable him to share his docs and answer questions in a public manner so his e-mail box does not fill up with duplicate requests. I know how quickly one's e-mail can become backed up when you have many people asking questions, and it would be to everyone's benefit for him to share with everyone just once instead of exerting so much energy answering the same questions over and over via email.



The same goes to any of you in communication with Winston Shrout, McLoud, Cornforth, etc... I truely hope these great minds will take advantage of this free resource to reduce their backlogs and free up their time that can be spend doing research, or whatever they would rather be doing!

Tora is not my real name, so he isn't going to have clue who you are talking about, but thanks anyway!

That is an excellent idea but Howard will be the first to tell you he uses his computer to hold open the door. His wife uses it once in a while but he never touches the stuff. I wish he would believe me I do.
