Late fee removal?

I will admit that since my layoff , I have been making my mortgage payments a little late. Not 30 days late, but a week or two. You know, enough to get a late fee added to the bill. Well , everytime I send the check off, I only write the check for the amount of the original payment , without the late fee included. And I always put the date it was due on the check. Is'nt there some law that says if they accept the check(endorse and deposit into their account), then they accept it under the conditions presented? If so I would think that would be grounds for getting the late fees removed. Otherwise, why not send the check back with a reason as to why it is not acceptable?

Do yourself a favor and get a land patent on your property---now.

I agree with you. The accepted your offer. The checks that you have are DATED and a copy of that check (with date and amount) should be sufficient proof.



To rebut they would have to offer proof of when the received the check or when you mailed it or when you wrote it or that they did not accept your offer. It could also be implied that they are slow at their bookkeeping duties. l o l.



oh yeah... and I concur with Jerseee. If nothing else, assert your rights in the land patent.
