I am anticipating the bank/ credit union calling me concerning the request for verification and the CPN I will be sending. SHould my response to them over the phone be similar to those posted reponses for a debt collector?

NEVER do business over the phone.
Always request that all further communication be done in written form... and stick to it. They fall into dishonor by not honoring your request. It is for your protection as well as theirs to keep everything in writing.

want to make them spit-sputtering mad? Tell them you have no way of knowing who they are or that they are who they claim to be and that you do not do any business over the phone. Then tell them (at this point they will begin spoutingsomething ....)just keep talking in a calm reasonable voice as you continue to say, "I do not do business over the phone. If you have something you feel I need to see, please put it IN wrting, SIGN IT and include an actually physical address where you receive your mail." Then move on. If they send something and you have already sent a VoD, just state, I am in receipt of your correspondence of (date) however, it is non-responsive to my demand for verification. Please re-read that correpondence and respond as requested.

If they persist, I am sure they are famililar with the Johnson v MBNA case from the court of appeals decided Jan, 2004. Request for verification is an issue in this case. There is another post regarding this -- court cse -- big news. A link to the case is included.

Greetings Dochand,
I have a most informative site which may interest you and possibly others. Go to creditwrench.blogspot.com, then scroll down to Sunday, June 6th, 2004. This will give you 18 questions for debt collectors. Especially, AFTER one has requested validation and cease communication. I also tend to agree with some of the more seasoned members. THEY are in dishonor for even calling you after you sent them written notice to cease communication other than by mailing. They are also violating the Fair Debt Collections Practices Act, in the event an artificial person wishes to charge them. And, if you have seen the movie "Phone Booth", just remember the killer's last words, that which invokes his ire, "Somebody's gotta pick up the phone".

Thanks to all you guys & gals for your responses.
I know they have cleared-up the slight confusion I had regarding the post-VOD/CPN submission.
I also trust that the responses have also assisted those who have not asked similar questions or were not sure of the stance to be assumed once the VOD/CPN has been received by the CC.
Most responses have been quite helpful and some have even made me LOL!
I hope all that are following this lawful process are having fun. Trust me, I know it can be a bit scary. Even though one believes he/she has a good grasp of the knowledge required, there's always that bit of doubt that the mind grabs onto and makes it bigger than it truly is.
Anyway, thanx to all. I'm really enjoying the (sometimes scary) journey thus far and realize I've only bitten off a small piece of the whole pie. Thank God I have a good appetite! I'll be back for more.
