!! VOD template download correction !!

everyone:

The VOD file I uploaded on 06-11-04 contains an error.

The payee on the CPN should be the Debt Collector's firm, NOT the alleged Creditor. I've uploaded a corrected file for the Admin to replace the old one with.

I understand that. I am asking because would you not use the term Alleged Creditor if that is who you are dealing with in the case of asking for verification from an alleged creditor who is not complying with your wish, but has yet to send it out to a third party debt collector?

You wouldn't. Nor would you ask for verification (VOD, FDCPA stuff) from an alleged creditor. For that party, all you'd send is the OOP, CPN, and VoToP, all with the word "alleged" deleted.

Removing the word "alleged" from anything--would imply validity.



Anyone can ask for verification of an alleged debt from anyone. Whether it be "creditor" or "debt collector". One cannot honestly expect to pay something that is not valid--no matter what the source of the claim may say.



It is either an "alleged debt" or "a debt". One term implies certainty the other does not. That is the whole purpose of doing a Verification of Debt (VoD).



However, if you have a strategy that involves not using the word "alleged", then I apologize for my impertinence on your process.

Agreed as well.



You can put into your document that ABC & Co. is functioning in the capacity of a debt collector however, my take would be to refer to them throughout your communication as "alleged creditor".



here is an example:



JACK JONES, a debt collector,

hereinafter “Alleged Creditor ”

CHASE, MANN & HATT

5143 Tunnel Vision Drive

Columbus, OH 43222

I'm already aware of all that. I should have stated one should only send the 3 doc's from the VOD I mentioned if one wanted to discharge it w/o verification (just to get them off your back). If one is demanding verification from an original creditor, one must eliminate the Debt Collector Disclosure Statement and remove FDCPA references as it doesn't apply to them.
