DISPUTE THE VALIDITY

I NOTICED BOTH CREDIT CARD AND MORTGAGE COMPANIES USE THE SAME LEGALESE:



"YOU HAVE 30 DAYS TO DISPUTE THE VALIDITY OF THIS DEBT".

"WE CAN PROVIDE TO YOU VERIFICATION OF THE DEBT OR A COPY OF ANY JUDGEMENT ENTERED AGAINST YOU"

"WE CAN PROVIDE TO YOU THE NAME OF THE ORIGINAL CREDITOR,BLAH,BLAH.....





MY MORTGAGE IS BEING SERVICED BY A DIFFERENT LENDER THAN THE ORIGINATOR OF THE NOTE.



MY QUESTION IS:

IS THE CURRENT SERVICER OF THE MORTGAGE ACTING AS A THIRD PARTY DEBT COLLECTOR JUST LIKE THE CREDIT CARD COLLECTION AGENCY?



IF NOT, WHAT'S THE DIFFERENCE?

I think yes, the bank that is a servicer is actually acting as a debt collector for the third party who is actually holding the Note that has been monetized.



This is my thought. I haven't proven it, YET.

YOU COULD BE RIGHT HENRY. HOWEVER, I UNDERSTAND THAT WHEN IT COMES DOWN TO FIGHTING THE MORTGAGE LENDER IN COURT THE MAIN ISSUE IS THE FRAUDULENT CONTRACT INVOLVING THE PROMISSORY NOTE AND THE DEED OF TRUST(OR MORTGAGE).



I NOTICED ONE OF YOUR THREADS YOU STARTED BY REQUESTING VALIDITY OF THE DEBT TO A MORTGAGE COMPANY.

ARE YOU GOING TO COURT SOON?

Going to court? Surely.



I am preparing for it now. UCC says that if you demand exhibition of the instrument (Note) they have to provide it.



So demand exhibition.
