FDCPA Violation

Yesterday, I got tired of a CA calling me so I sent them a DV with a C&D via FAX. and today they call me and left a message. (violation!!!!) I am so happy. My question is it a violation per action or per violation the company do under the FDCPA......

Also, should I let them know that they violated or should I wait until they validate my debt which would be 30 days.....

More time and proof of service

Instead of using FAX as a form of informing them, you should use "Snail Mail". Use tracking for proof that the item was delivered. Use a notary as a disinterested third party with a proof of service inserted.

Also, I know many like to use "certified mail". I personally use it rarely. I use a private courier as this does not give our civil servants the ammo to try and "charge" me with any type of "mail fraud" as I am not using THEIR system.

With today's imaging technolgoies, an alleged record of a fax transmission is problematical as "evidence."

Stick with what works - the mail.

Mail is the best approach, rather than fax.
