that is a viable document to have in one's library.& the Certificate of Non-response that i accomplished incorporates part of the affidavit but, not in detail--I may want to consider revising my docs for future battles.

Greetings to you. I have&been blessed to have&the CRA's remove child support, bankruptcy and a plethora of other erroneous, invalid and unverifiable&negative reports from the file.


The reason for this post is:


If they DO NOT remove the liens, what then?&


Maybe you can draft some verification papers regarding the liens in question. Take a look at the Federal Lien Registration Act (if there is such a thing). Also, at the Infernal Revenue website, you can get the IRS manual

<FONT size=3>The way I look at it is this: Liens are no&different from&the other items on the report&so they shouldn't be treated&differently.& If they can't verify the liens are valid, then they need to delete those items. </FONT>

that is the way. Keep attacking and hold them to the code! My first couple of tries were paper intensive but, I refined my approach and found lots of progress.

Good luck and do not relent.

If they cannot verify it and do not remove it, they are in non-compliance with the code. Also, they are committing fraud and maybe even some liable claims can be made as well since they are a public agency distributing potentially false and misleading information.

One of the reasons I have had success with them is because I kindly remind them that a lot of other charges can be waged against them other than the code. And all one has to do is go down to the local court house and file a complaint. It should be rather easy since you are already in honor. And there is a host of annotated statutes that reference libel suits, fraud, mail fraud, misrepresentation, conspiracy, and on and on.

Long time, glad to be on the forum again.


Since I began cleaning the credit report for my commercial "strawman" self, I have found that "most" of the negatives will eventually come off. The purpose for my above post is simply a "PLAN B", if they don't delete the non verified liens.


Also, I am going through a court issue with a debt collector/attorney. They were assigned the Credit Card contract/account and are trying to collect $11,548.


Honestly, I thought I knew how to deal, but, it is different when it is really in yo' face. Anyway, I am looking into challenging&jurisdiction because the debt collector is not registered to do business in California. Also, thinking of chaning venue to district court and throw in a 12(b)(6) "failure to state a claim in which relief can be granted".

maybe this may help...I was gently reminded here by Jim or James that no one can purchase evidence.

Also, this alleged debt of 11K+ that you speak of....did the any one of the CRAs delete it off of your strawman's credit (debt) report?

If so, that is your smoking gun that the debt cannot be verified. You can say that you had a disinterested third party (which is a public agency) investigate the validity of the debt and found it to inconclusive.

I woudl say this (just as I did in January to child support enforcement--who was trying to get more money off of an old judgement in 1996).. Furthermore, I agrree that I owe the debt and will satisfiy it dollar for dollar, if the alleged creditor can show proof of their claim or show proof of our contractual agreement.

then at the the same time I wrote that, I sent a CPN as a good faith payment. then just 3 weeks ago, one of the CRAs deleted the entry.

Now that is honor and a small win. Does this give you any ideas on a strategy?

Bruh, I highly recommend you get the CRAs involved. Hell, I bet they are reporting this to folks!

I thought of it, but just put it on the back burner. I will check to see if I can get the credit report expedited online or something. Tonight I will draft the reqest for verification for the CRA's. The hearing is scheduled for 3-30-04. That may give enough time for the investigation to come back, if I do it all tomorrow.&

That is not enough time. You can try but, usually they (CRAs) take at least 3 weeks to prepare a response.

Yeah. Time is of the essence.&Maybe I can postpone the hearing date. Or, I can subpoena the documents (credit report).


BTW, can you shed more light on the "purchasing evidence" issue. Thanks.
